CITY OF LOUISVILLE <br /> <br />MARCH 16, 1999 <br /> <br />REGULAR COUNCIL MEETING <br /> <br />The City Council of the City of Louisville met in a regular session in the Council <br />Chambers at City Hall, 749 Main Street, Louisville Colorado. Mayor Tom Davidson <br />called the meeting to order at 7:00 p.m. and the following persons were present - <br /> <br />City Council: <br /> <br />Mayor Tom Davidson, Mayor Pro-Tem Chuck Sisk, Kevin <br />Howard, Rob Lathrop, Tom Mayer, Jay Keany (7:05 <br />p.m.), and Arnold Levihn <br /> <br />Staff Present: <br /> <br />Bill Simmons, City Administrator <br />Paul Wood, Planning Director <br />Tom Phare, Public Works Director <br />Dianne Ray, Finance Director <br />Bruce Goodman, Chief of Police <br /> <br />Also Present: <br /> <br />Sam Light, City Attorney <br /> <br />APPROVAL OF AGENDA <br /> <br />Davidson called for any changes to the Agenda. <br /> <br />Sam Light, City Attorney, requested that Agenda Item 6G - Appeal of Planning <br />Commission Resolution No. 13, Series 1999, be removed from the Agenda. He explained <br />that there is a public notice requirement that has not been met and, therefore, this item <br />will need to be put off until a later date. <br /> <br />Davidson removed Agenda Item 6G from the Agenda, and asked Light to clarify this for <br />Council. <br /> <br />Light replied that under the Louisville Municipal Code, if there is an appeal of a <br />Preliminary Plat, the City Council can hear the appeal, but only after publication by <br />notice at least five days prior to the hearing. Unfortunately, that notice did not make it <br />into the paper and was not given. Because notice is jurisdictional for the appeal, we will <br />not be able to proceed with the appeal tonight. <br /> <br />Davidson stated that this item would be continued to the April 6, 1999, City Council <br />meeting. <br /> <br />Sisk stated that tonight he had intended to raise a jurisdictional issue on the appeal. He <br />explained that he did not feel the appeal was well taken in view of the fact that the <br /> <br /> <br />
