Zane also testified hearing something outside as she <br />was closing the bar and to witnessing part of the fight in the parking lot. <br />Jon Travis Rumley, 855 W. Dillon Road, Louisville, CO took the stand. He stated <br />he was at The Back Room that evening to see some friends. He said he was not <br />there during the incident with the ring but was involved with the fight in the <br />parking lot. <br />Mr. Newman entered two pieces of evidence into the record and then testified <br />himself. He had a letter from the management company for the shopping center <br />where his bar is located and which spoke about what part of the premises <br />/' <br />belongs to The Back Room. He also entered a transcript from a previous show <br />cause hearing which addressed questions about the premises. <br />Chairperson Mulvahill called Mr. Richardson back to the stand to ask some <br />questions about a phone call he received from Travis Rumley. <br />Chairperson Mulvahill re-called Stephen Robertson to the stand. Questions were <br />asked about the time frame of the incident. <br />Mr. Fredricksmeyer and Mr. Newman presented their closing arguments. <br />The Authority members discussed the evidence presented. <br />Mulvahill moved that sufficient evidence has been presented to support the <br />following charges stated in the Show Cause Order: <br />A. Colorado Code of Regulations, Regulations Relating to Alcohol <br />Beverages S 47-900.A, stating in pertinent part that the licensee as well <br />as any employee or agent of licensee shall conduct the licensed <br />premises in a decent, orderly and respectable manner, and shall not <br />permit any activity or acts of disorderly conduct as defined by and <br />provided for in Section 18-9-106, C.R.S. nor shall a licensee permit <br />rowdiness, undue noise, or other disturbances or activity offensive to the <br />senses of the average citizen, or to the residents of the neighborhood in <br />which the licensed establishment is located. <br />B. Louisville Municipal Code S 9.22.050, stating any licensee shall <br />immediately report to the City police department any unlawful or <br />disorderly act, conduct, or disturbance committed on the premises. <br />Mulvahill further moved that the Authority Attorney be directed to prepare a draft <br />of final findings, conclusions and an order for consideration at the Authority's next <br />meeting to be held on May 22, 2006, and the matter be continued until that time. <br />Wilson seconded. Roll Call Vote: Mulvahill - yes, Wilson - yes, Rommelfanger <br />- yes and Carlson - yes. Motion approved. <br />
