She did not support <br />encroachment in the City's open space and stated it is fundamentally unfair. She <br />thanked the Open Space Advisory Board and the Land Management Staff for <br />managing the open space land for the community. She emphasized the open <br />space belongs to all the citizens. <br />Jim Stuart, 1082 W. Alder Street, Louisville, CO suggested the Council defer the <br />decision on the ordinance to allow more discussion. He explained his home <br />backs up to Harper Lake and he has utilized open space property since 1986, <br />with the City's permission. He stated he has a flagstone path and railroad ties <br />from his home to the open space and requested it be grandfathered in. <br />Eva Kosinski, 1301 Jackson Court, Louisville, CO addressed the requests for <br />"rights" and stated they are "privileges" and not "rights." She explained this is an <br />issue of property rights and the open space is owned by all the residents. She <br />voiced belief the issue should be decided by the Court. She requested the <br />ordinance be tabled until ownership is decided by a Court. <br />Damond Devincenzi, 1001 Rex Street, Louisville, CO supported the open space <br />rules and regulations. He voiced his belief the open space belongs to all the <br />citizens and urged Council to adopt the rules and regulations. <br />COUNCIL COMMENT <br />Council member Sackett stated one of the things that makes Louisville special is <br />all the open space and the trails. He stated many of the residents do not look at <br />the City's Web Page, and are not informed as to the issues. He agreed there <br />should be some rules and regulations over open space land, but felt there are a <br />lot of gray areas. He supported continuing the ordinance to allow more <br />discussion. <br />Council member Muckle stated spoke to several residents who are in favor of the <br />ordinance. He voiced his respect for the Land Management Staff. He asked the <br />Land Management Staff the status of the re-vegetation of the reuse pipeline. <br />Open Space Coordinator Moline stated the re-vegetation of the reuse pipeline is <br />going as well as can be expected over the course of time. The larger area <br />between the re-use pipeline and the trail, on the northern portion of Dutch Creek, <br />has not improved and the Land Management Department will be working on that <br />area this spring. <br />Council member Muckle asked if there was a reason why there is a prohibition on <br />wash/repair of automobiles if they cannot be parked in the open space. <br />City Attorney Light stated there is some redundancy, but explained if a car is <br />parked in a designated parking place, it cannot be washed. <br />
