<br /> City Council <br />Meeting Minutes <br />February 21, 2006 <br /> Page 3 of 13 <br />Mayor Sisk responded to Mr. Deborski's request and noted the City has spoken <br />to Boulder County relative to moving the center line of the highway on to open <br />space land. <br />City Manager Simmons stated the proposed Highway 42 Plan will be presented <br />at the February 28 City Council Study Session. <br />Mayor Sisk reported Xcel Energy has committed to three sites in the County for <br />their high-pressure gas line. He noted one of the sites would impact the City of <br />Louisville. He suggested this issue be discussed by the Finance Committee and <br />Council and consideration be given to hiring consultants to represent the City at <br />the County Commissioners hearings. There was Council consensus. <br />With respect to the Xcel Energy high-press gas line, Council member Sackett <br />stated he received a notice, which stated a response was required by February <br />23, 2006. Assistant City Manager for Governmental Relations Balser confirmed <br />the City would respond prior to the deadline. <br />REGULAR BUSINESS <br />SAWYER LITIGATION MATTER/FRONT STREET RIGHT-OF-WAY VACATION <br />RESOLUTION No.6, SERIES 2006 - <br />APPROVAL OF MUTUAL RELEASE AND <br />SETTLEMENT AGREEMENT: KENNETH E. <br />SAWYER ET AL. V. CITY OF LOUISVILLE, <br />CASE NO. 05CV52, BOULDER COUNTY <br />DISTRICT COURT, DIVISION 5 <br />Mayor Sisk requested a Staff presentation. <br />City Attorney Light reviewed the settlement agreement presented in Resolution <br />No.6, Series 2006 and read Ordinance No. 1487, Series 2006. Resolution No.6, <br />Series 2006 authorizes approval of a proposed mutual release and settlement <br />agreement for the pending lawsuit over ownership of a 60-foot by 50-foot portion <br />of the south Front Street right-of-way, lying between the properties owned by <br />Kenneth and Bernadine Sawyer and Denise and Philip Ehrmann. Ordinance No. <br />1487, Series 2006 is a vacation ordinance to implement the proposed settlement. <br />The main points of the settlement agreement include the following: <br />. The City retains a 15-foot portion of the right-of-way. The remaining <br /> portions will be vacated and the parties will exchange deeds to confirm the <br /> ownership arrangement. <br />
