<br /> City Council <br /> Meeting Minutes <br /> February 21, 2006 <br /> Page 5 of 13 <br /> Jean Morgan, 1131 Spruce Street, Louisville, CO expressed her opposition to the <br /> settlement agreement and stated the City would be giving away their rights and <br /> paying for a street they already own. She urged Council to deny the settlement <br /> proposal. <br /> Melisa Devincenzi, 1001 Rex Street, Louisville, CO presented Council with a <br /> document with the signatures of ten residents who oppose the Sawyer <br /> Settlement Agreement. She addressed safety concerns for small children and <br /> for elderly residents, and urged Council to deny the settlement agreement. <br /> Damond Devincenzi, 1001 Rex Street, Louisville, CO presented a copy of a <br /> petition, which was circulated last year, and signed by 134 residents who <br /> opposed vacating the Front Street right-of-way. He supported a judge and jury <br /> decision on the settlement of this issue and urged Council to deny this settlement <br /> proposal. <br /> Tom Rafferty, 945 Rex Street, Louisville, CO stated the City and its taxpayers <br /> own the street right-of-way. He supported a Court decision on this matter, or a <br /> 20/20/20 split of the right-of-way. He asked if the settlement agreement restricts <br /> usage of the right-of-way for the next ten years, provides for 6-foot fences along <br /> property lines and allows the owners to remove their property's setbacks lines <br /> and increase their current floor area ratios. He noted those would negatively <br /> impact the view corridors. <br /> Barb Hesson, explained she has two addresses, 411 County Road, and 526 <br /> LaFarge Avenue, Louisville, CO. She stated her understanding an individual <br /> could not legally infringe on City property, and requested the Council deny the <br /> settlement agreement. City Attorney Light confirmed an individual cannot <br /> infringe on government land. <br /> Mike Deborski, 601 Pine Street, Louisville, CO stated his understanding of the <br /> Sawyer property issue, and noted the documentation in the past was not properly <br /> kept or recorded. He stated the proposed settlement is an option. He did not <br /> favor going to Court over this issue, and voiced his support of the settlement <br /> agreement. <br /> COUNCIL COMMENT <br /> Mayor Pro T em Brown asked for clarification on the setbacks and fencing issues <br /> raised by Mr. Rafferty. City Attorney Light explained there are provisions for <br /> setback requirements in the resolution and ordinance and any fencing would <br /> require City approval. <br /> Mayor Pro Tem Brown stated his understanding the settlement did not include <br /> expansion of property lines. <br />
