City Council Meeting Minutes March 7, 2006 Page 6 of 16 . The term of the franchise is seven years. . The effective date of the franchise shall be April 11 ,2006. The prior franchise shall be in effect until April 11, 2006. . The franchise fee shall be 5% of gross revenues. . Customer Service Standards are referenced in the document as Appendix B (6.1). The Standards set forth in this ordinance constitute Appendix B. . One Government Access and one Public Access channel are provided as part of the Basic Cable Service Tier. . The franchise will continue to provide the Educational Access Channel to BVSD and such programming shall remain as part of the Basic Cable Service Tier in the City as long as BVSD continues to program the channel. . Comcast shall continue to provide and maintain a return line from City Hall to the Cable System Headend as well as return lines to the Police Department and Recreation and Senior Center. Comcast will also construct and maintain return lines from the Cable System Headend to the City's new Library at 951 Spruce Street. . If the City requests a return line to a facility operated by a Designated Access Provider of Public Access programming, Comcast shall construct such return line at its expense, if the location is within 125 feet from its distribution cable. . Within 90 days of the Effective date of the franchise, Comcast shall provide a one time grant of $80,000 to outfit City Council chambers and other facilities and to purchase field equipment to produce Access programming. Comcast is entitled to recover this contribution from residential subscribers. This will be recovered through a .50 cent PEG fee to subscribers. . Com cast shall notify the City when the Access Capital Contribution has been recovered. Once recovered, or 42 months whichever comes first, upon sixty days written notice from the City, Comcast shall provide to the City an amount, not to exceed .50 cents per residential subscriber per month. . The technical performance of the Cable System shall meet or exceed all applicable technical standards authorized or required by law. . Comcast shall provide standby power generating capacity at the Cable System Headend capable of providing at lease twelve hours of emergency operation. . Monetary Damage amounts are set out in Section 15.3 of the proposed franchise. The proposed franchise does not include reference to maintenance of a local office. The Cable operator shall provide customer service centers within 10 miles from the service area. The request that Comcast maintain a Basic Tier Service Level is not a part of the official franchise document however Comcast has filed a letter stating their intentions regarding this service within the City of Louisville.
