The effective date of the franchise shall be April 11 ,2006. The prior <br /> franchise shall be in effect until April 11, 2006. <br /> . The franchise fee shall be 5% of gross revenues. <br /> . Customer Service Standards are referenced in the document as Appendix <br /> B (6.1). The Standards set forth in this ordinance constitute Appendix B. <br /> . One Government Access and one Public Access channel are provided as <br /> part of the Basic Cable Service Tier. <br /> . The franchise will continue to provide the Educational Access Channel to <br /> BVSD and such programming shall remain as part of the Basic Cable <br /> Service Tier in the City as long as BVSD continues to program the <br /> channel. <br /> . Comcast shall continue to provide and maintain a return line from City Hall <br /> to the Cable System Headend as well as return lines to the Police <br /> Department and Recreation and Senior Center. Comcast will also <br /> construct and maintain return lines from the Cable System Headend to the <br /> City's new Library at 951 Spruce Street. <br /> . If the City requests a return line to a facility operated by a Designated <br /> Access Provider of Public Access programming, Comcast shall construct <br /> such return line at its expense, if the location is within 125 feet from its <br /> distribution cable. <br /> . Within 90 days of the Effective date of the franchise, Comcast shall <br /> provide a one time grant of $80,000 to outfit City Council chambers and <br /> other facilities and to purchase field equipment to produce Access <br /> programming. Comcast is entitled to recover this contribution from <br /> residential subscribers. This will be recovered through a .50 cent PEG fee <br /> to subscribers. <br /> . Com cast shall notify the City when the Access Capital Contribution has <br /> been recovered. Once recovered, or 42 months whichever comes first, <br /> upon sixty days written notice from the City, Comcast shall provide to the <br /> City an amount, not to exceed .50 cents per residential subscriber per <br /> month. <br /> . The technical performance of the Cable System shall meet or exceed all <br /> applicable technical standards authorized or required by law. <br /> . Comcast shall provide standby power generating capacity at the Cable <br /> System Headend capable of providing at lease twelve hours of emergency <br /> operation. <br /> . Monetary Damage amounts are set out in Section 15.3 of the proposed <br /> franchise. <br /> The proposed franchise does not include reference to maintenance of a local <br /> office. The Cable operator shall provide customer service centers within 10 miles <br /> from the service area. The request that Comcast maintain a Basic Tier Service <br /> Level is not a part of the official franchise document however Comcast has filed a <br /> letter stating their intentions regarding this service within the City of Louisville. <br />
