ORDINANCE No. 1506, SERIES 2006 - AN ORDINANCE REPEALING AND REENACTING CHAPTER 3.18 OF THE LOUISVILLE MUNICIPAL CODE REGARDING DEVELOPMENT IMPACT FEES FOR MUNICIPAL CAPITAL FACILITIES, TRANSPORTATION CAPITAL FACILITIES, LIBRARY CAPITAL FACILITIES, PARKS AND TRAILS CAPITAL FACILITIES AND RECREATION CAPITAL FACILITIES - 2nd reading - Public Hearing (Advertised Daily Camera 12/10/06) Mayor Sisk requested a City Attorney introduction. City Attorney Light read Ordinance No. 1506, Series 2006. He noted there is an addition of a street map, showing thl3 City's arterial streets. Mayor Sisk opened the public hearing and requested a Staff presentation. Interim City Manager Balser explained Ordinance No. 1506, Series 2006 repeals and re-enacts Chapter 3.18 of the Municipal Code to update the impact fees. The changes made to Ordinance No. 1436, Series 2003 provides additional impact fees and repeals the service expansion fee and major thoroughfare fee effective as of the effective date of the ordinance. An impact fee study November 9,2006 provided the methodology and application of such fees. In 2006 TischlerBise was hired to calculate the appropriate impact fees related to the need for new capital facilities resulting from residential development. In addition to a study for transportation, police and municipal facilities impact fees; City Council requested the City update the methodology for its residential fees. Currently the City has a Capital Improvement Fee for residential units, which requires payment of $1 ,650 per unit (Major Thoroughfare Fee) as well a charge of $2.60 a square foot of floor area for the proposed unit (Service Expansion Fee). The study provides three new residential impact fees for 1) Library, 2) Parks and Trails (includes Open Space) and 3) Recreation which will replace the City's current residential fees. Additionally, the study reviewed the previous impact fees for transportation, municipal facilities and police to determine whether any adjustments were warranted as a result of the finalized Comprehensive Plan detailing revised population and development figures, and in view of updated demand and cost assumptions.
