Finally, since use of "Parcel E" as a Catholic Church is the use represented to us <br />as purchasers, and since we believe a Church would be one of the best neighbors we <br />could have, we call on the St. Louis Catholic Church to work constructively with the City <br />of Louisville to develop acceptable plans for construction and occupancy of its facility on <br />the subject parcel. <br /> <br />I/ery Sincerely, <br />Wilbur P. Kauffman, President <br />Cherrywood II HOA <br /> <br />Davidson requested that Sam Light, City Attorney, explain the Master Development <br />Agreement. <br /> <br />Sam Light, City Attorney, explained that Centennial Valley is governed by a general <br />development plan, which calls out specific parcels, this being "Parcel E". He stated that <br />he is working with Planning Department staff to determine the full history of this parcel. <br />However, pursuant to the Fifth Amendment in 1995, retail designation was removed from <br />Parcel E, which removed any retail use of that parcel. The parcel was also split, with a <br />portion going to residential and the other half went to 'mixed-use.' There was an <br />underStanding that there would be no retail use on the parcel, and perhaps other types of <br />mixes uses might be permitted, but they would not include retail or other forms of retail <br />commercial use. He stated that he is currently working with the Planning Department <br />staff to fully identify what that might mean. There was a subdivision plat and a <br />preliminary PUD approved for the site a number of years ago that was on the assumption <br />of a church, a school, and other uses proposed by the Archdiocese at that time. That plan <br />has not moved forward. In 1995, there was a Fifth Amendment that removed retail use <br />from that parcel and the full history of that action is still under investigation. <br /> <br />Davidson explained that the Agreement is between the State of Colorado, the master <br />developer, and the City. Therefore, the City, by itself, is not free to change the agreement. <br />He stated that during the Fifth Amendment, without making any major change in the <br />zoning, simply moving space from one parcel to another took over a year. Davidson felt <br />that it was highly unlikely that the parcel would be anything other than what its current <br />allowed uses are. <br /> <br />Kauffman thanked the Mayor and Council for hearing their concerns. <br /> <br />Ayse Strahm-Bergh, 891 Larkspur Court, Louisville, explained that she lives on the other <br />side of Cherrywood II. She agreed with Kauffman. <br /> <br />Doug Harper, 1160 S. Boulder Road, Louisville, asked to comment on the postponement <br />of the S. Boulder Road closure. He stated that he finds it inconceivable a road of this size <br />could actually be closed for an entire week and questioned whether Council could request <br />that the project be complete one lane at a time. <br /> <br /> <br />
