RESOLUTION NO. 11 <br />SERIES 2024 <br />A RESOLUTION RECOMMENDING APPROVAL OF AN ORDINANCE AMENDING <br />THE LOUISVILLE MUNICIPAL CODE TO ALLOW AND REGULATE NATURAL <br />MEDICINE BUSINESSES <br />WHEREAS, the City of Louisville (the "City"), is a Colorado home rule municipal <br />corporation duly organized and existing under laws of the State of Colorado and the City <br />of Louisville Home Rule Charter (the "City Charter"); <br />WHEREAS, the People of the State of Colorado approved the citizens' initiative <br />known as "Proposition 122: Access to Natural Psychedelic Substances," which is codified <br />in Colo. Rev. Stat. § 12-170-101, et seq. (the "Enabling Act") in November 2022; <br />WHEREAS, the Enabling Act decriminalizes the personal possession, growing, <br />sharing, and use, but not the sale, of natural psychedelic mushrooms (psilocybin and <br />psilocin) and plant -based psychedelic substances (dimethyltryptamine, ibogaine, and <br />mescaline), hereby referred to as Natural Medicine; <br />WHEREAS, the Enabling Act allows for the supervised use of psychedelic <br />mushrooms by individuals aged 21 and over at licensed facilities; <br />WHEREAS, the Enabling Act allows for the cultivation, product manufacture, and <br />testing of Natural Medicine at licensed facilities; <br />WHEREAS, the State Legislature enacted Senate Bill 23-290, which is codified in <br />Colo. Rev. Stat. § 44-50-101, et seq. (the "Regulatory Act"), which establishes licensing <br />requirements and regulations for Natural Medicine businesses, including healing centers, <br />cultivation facilities, and products manufacturers; <br />WHEREAS, the Regulatory Act prohibits local governments from banning Natural <br />Medicine businesses within their boundaries, but allows them to adopt and enact <br />ordinances governing the time, place, and manner of the operation of licensed businesses <br />and further allows them to vary the distance restrictions imposed by the Regulatory Act; <br />NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the City <br />of Louisville, Colorado does hereby recommend approval of an ordinance amending <br />Louisville Municipal Code to allow and regulate Natural Medicine Businesses <br />PASSED AND ADOPTED this 10th day of October, 2024. <br />By: <br />Steve Brauneis, Chair <br />Planning Commission <br />
