RESOLUTION NO. 19 <br />SERIES 2023 <br />A RESOLUTION RECOMMENDING APPROVAL OF A FINAL PLANNED UNIT <br />DEVELOPMENT, SPECIAL REVIEW USE, PLAT, EASEMENT VACATION, AND <br />ANNEXATION AGREEMENT AMENDMENT TO ALLOW DEVELOPMENT OF A <br />DISTILLERY, TASTING ROOM, AND EVENT SPACE AT 1303 EMPIRE ROAD. <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application for a final planned unit development and special review use to allow <br />development of a distillery, tasting room, and event space, a plat and easement vacation <br />to amend existing easements, and an annexation agreement amendment to amend a no <br />building zone at 1303 Empire Road; <br />WHEREAS, City staff has reviewed the information submitted and found that the <br />application complies with the Louisville zoning regulations and other applicable sections <br />of the Louisville Municipal Code; and <br />WHEREAS, the Planning Commission has considered the application at a duly <br />noticed public hearing on December 14, 2023, where evidence and testimony where <br />entered into the record. <br />NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the City of <br />Louisville, Colorado does hereby recommend approval of the Planned Unit <br />Development, Special Review Use, Plat, Easement Vacation, and Annexation <br />Agreement Amendment, with the following conditions: <br />1. The Annexation Agreement, and all references to it on the Plat and PUD, be <br />amended to move the location of the development restriction on the property, <br />outlined in Section 3 of the Agreement and referred to as the "No Building Zone" <br />on the 2005 Plat, to accommodate the proposed main building of the Ironton <br />PUD. The development restriction would remain to the west of the main building, <br />with the exception that landmarked structures be allowed in the No Building <br />Zone <br />2.
