RESOLUTION NO. 43 <br /> SERIES 1998 <br /> <br /> A RESOLUTION APPROVING <br />A FINAL PUD DEVELOPMENT PLAN FOR <br />BUSINESS ANSWERS AT 728 MAIN STREET <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final PUD Development Plan for a two and three story, multi-tenant, office and <br />retail building at 728 Main Street; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan have been reviewed <br />by City Staff and the Planning Commission and found, with conditions, to be in compliance with <br />the Louisville zoning ordinances, subdivision regulations, and related policies; and <br /> <br /> WHEREAS, after a properly advertised public hearing concerning said Final PUD <br />Development Plan, the Planning Commission recommended approval to the City Council, with <br />conditions; and <br /> <br /> WHEREAS, the applicant has revised the application in response to Planning Commission <br />recommended conditions and City Council finds that said Final PUD Development Plan should <br />be approved, with the following conditions: <br /> <br />Applicant shall submit an overall sign package for approval by the Commission and City <br />Council through a Final PUD application and all references to signage shall be removed <br />from this Final PUD. <br /> <br />The following note shall be added to the PUD: "The owner acknowledges there is a need <br />for additional parking in the Central Business District, and that the development approved <br />herein will contribute to that need. Owner acknowledges that it will benefit by additional <br />parking in the Central Business District and hereby agrees to participate in the financing <br />of future public parking improvements on an equitable basis with other properties and <br />businesses benefitted by such additional parking. Such participation may include by way <br />of example and not limitation, payment of impact fees and assessments. The owner further <br />acknowledges that if an improvement district, impact fee or other mechanism for financing <br />additional downtown parking is not in place at the time of building permit issuance, the <br />owner will be required to provide parking to meet the parking requirement for the project <br />at a ratio of two spaces per 1,000 square feet of gross floor area, pursuant to Sections <br />17.20.120 and 17.20.140 of the LMC.
