<br />by any persons aggrieved who are affected by any decision of the <br />zoning administrator, or by the City Administrator of the City on <br />behalf of the City. Such appeals must be taken within 30 days of the <br />decision made which is being appealed. Appellant shall file with the <br />zoning administrator and with the Board a notice of appeal specifying <br />the grounds for such appeal. Accompanying the notice of appeal will <br />be a filing fee which shall be one-half of the zoning amendment fee. <br />The zoning administrator shall immediately transmit to the Board all <br />papers constituting a record of action upon which the appeal was <br />taken. The Board of Adjustment shall fix a reasonable time for the <br />hearing of the appeal, give public notice by publication of at <br />least ten days notice prior to the hearing on the appeal and provide <br />notice by mail to property owners within 500 feet of the property on <br />which the decision was made. <br /> At the hearing, a party may appear in person or by agent or <br />attorney. The Board may affirm, reverse, reverse wholly or partly, <br />or modify the order, requirement, decision or determination appealed; <br />and may make such order, requirement, decision or determination as in <br />their opinion ought to be made in the premises, and to that end shall <br />have all powers that the officer from whom the appeal is taken. <br /> Section 3. The following section shall be added to Chapter <br />17.52 of Title 17 of the Louisville Municipal Code. <br /> 17.52.060 Building Permits. <br /> ( F ) Plans submitted with an application for a building <br />permit shall be reviewed and approved by all appropriate departments <br />of the City. <br /> 17.52.090 No Permits Prior to Subdivision. <br /> No building permit shall be issued on any property within <br />the City of Louisville for construction of a structure prior to the <br />completion of the subdivision process for said property as set forth <br />under Title 16 of the Louisville Municipal Code. For purposes of <br />this section, the term structure shall not include fences, flag <br />poles, or retaining walls. <br /> -2- <br />
