by any persons aggrieved who are affected by any decision of the zoning administrator, or by the City Administrator of the City on behalf of the City. Such appeals must be taken within 30 days of the decision made which is being appealed. Appellant shall file with the zoning administrator and with the Board a notice of appeal specifying the grounds for such appeal. Accompanying the notice of appeal will be a filing fee which shall be one-half of the zoning amendment fee. The zoning administrator shall immediately transmit to the Board all papers constituting a record of action upon which the appeal was taken. The Board of Adjustment shall fix a reasonable time for the hearing of the appeal, give public notice by publication of at least ten days notice prior to the hearing on the appeal and provide notice by mail to property owners within 500 feet of the property on which the decision was made. At the hearing, a party may appear in person or by agent or attorney. The Board may affirm, reverse, reverse wholly or partly, or modify the order, requirement, decision or determination appealed; and may make such order, requirement, decision or determination as in their opinion ought to be made in the premises, and to that end shall have all powers that the officer from whom the appeal is taken. Section 3. The following section shall be added to Chapter 17.52 of Title 17 of the Louisville Municipal Code. 17.52.060 Building Permits. ( F ) Plans submitted with an application for a building permit shall be reviewed and approved by all appropriate departments of the City. 17.52.090 No Permits Prior to Subdivision. No building permit shall be issued on any property within the City of Louisville for construction of a structure prior to the completion of the subdivision process for said property as set forth under Title 16 of the Louisville Municipal Code. For purposes of this section, the term structure shall not include fences, flag poles, or retaining walls. -2-
