<br /> ORDINANCE NO. 822 <br /> AN ORDINANCE ADDING SPECIFIC <br /> DEFINITIONS TO THE LOUISVILLE <br /> MUNICIPAL CODE. <br /> WHEREAS, there are certain terms and words utilized in the <br /> criminal sections of the Louisville Municipal code which are not now <br /> specifically defined; and, <br /> WHEREAS, the City Council has determined that certain terms <br /> should be defined in the Louisville Municipal Code. <br /> NOW THEREFORE, be it ordained by the City Council of the <br /> City of Louisville, Colorado: <br /> Section 1 . That the following section is hereby added to <br /> - <br /> Chapter 1 .04 of the Louisville Mun i c ipa I Code: <br /> 1.04.015 Additional Definitions <br /> The following words and phrases, whenever used in this <br /> code, shall be construed as defined in this section: <br /> A. "criminal negligence" - a person acts with criminal <br /> negligence when through a gross deviation from the standard of care <br /> that a reasonable person would exercise, he fails to perceive a sub- <br /> stantial and unjustifiable risk that a result will occur or that a <br /> circumstance exists. <br /> B . "intentionally" or "with intent" - a person acts <br /> "intentionally" or "with intent" when his conscious objective is to <br /> cause the specific result or conduct proscribed by the ordinance <br /> defining the offense or to engage in that conduct or when his actions <br /> are such as to give rise to a substantial certainty that such results <br /> will be produced. It is immaterial to the issue of specific intent <br /> whether or not the result actually occurred. <br /> C . "knowingly" or "willfully" - a person acts "knowingly" <br /> or "willfully" with respect to conduct, or to a circumstance de- <br /> scribed by an ordinance defining an offense, when he is aware, or <br /> reasonably should be aware, that his conduct is of such nature or <br /> that such circumstance exists. A person acts "knowingly" or "w i ll- <br /> fully", with respect to a result of his conduct, when he is aware, or <br />
