RESOLUTION NO. 33 <br /> SERIES 1998 <br /> <br /> A RESOLUTION APPROVING <br />AN AMENDMENT TO A FINAL PUD DEVELOPMENT PLAN <br />FOR LOT 4A, CENTURY OFFICE PARK <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of an Amendment to a Final PUD Development Plan for Lot 4A, Century Office Park; <br />and <br /> <br /> WHEREAS, all materials related to the Amendment to a Final PUD Development Plan <br />have been reviewed by City Staff and the Planning Commission and found, with conditions, to be <br />in compliance with the Louisville zoning ordinances, subdivision regulations, related policies, and <br />previous approvals; and <br /> <br /> WHEREAS, after a properly advertised public hearing concerning said Amendment to <br />a Final PUD Development Plan, the Planning Commission recommended approval to the City <br />Council, with conditions; and <br /> <br /> WHEREAS, the applicant has revised their application in response to Planning <br />Commission recommended conditions and City Council fmds that said Amendment to a Final PUD <br />Development Plan should be approved, with the following conditions: <br /> <br />The applicant shall utilize an integrally colored tint or stain in the concrete retaining wall <br />to darken the color of the wall to a color consistent with the exterior brick on the proposed <br />office building. Also, the applicant shall evaluate treatments for the concrete wall which <br />would facilitate the removal of graffiti from the surface of the wall. The color shall be <br />consistent with the sample provided as part of an overall project materials board at the <br />City Council meeting. <br /> <br />The PUD landscape plan shall be modified to delete clump aspen and replace in number <br />with ornamental stock of a type recommended in the plant listing for the Commercial <br />Development Design Guidelines and Standards. The minimum caliper of ornamental trees <br />shall be increased from 1.5 inches to 2.0 inches. <br /> <br />The landscape plan shall be revised to move the trees located along the west property line <br />to the west as far as possible and the applicant, by separate instrument, shall grant a deed <br />of easement to the city for an additional four feet, as provided in Condition 5, below. <br />Further, the landscape plan shall be revised to move the trees within the front setback <br />along the north property line to the south so to be outside the 10' utility easement. <br /> <br />The three existing trees which are recommended for removal shall be replaced with a <br />minimum caliper of 3" <br /> <br /> <br />
