EXHIBIT A, COLORADO UNIVERSAL PRESCHOOL PROGRAM SERVICE <br />TERMS AND CONDITIONS <br />6. Should Provider fail to notify CDEC of a child who has ceased enrollment or otherwise withdrawn <br />as described in (5) above, then CDEC shall have cause to terminate this Contract immediately. <br />7. In accordance with 8 CCR 1404-1 rule section 4.109(E), Provider must comply with the <br />requirements of section 22-33-106.1, C.R.S., regarding the limited circumstances under which <br />Provider may suspend or expel a child enrolled in the Colorado Preschool Program. <br />8. CDEC will pay Provider in accordance with the adopted provider rate and in accordance with the <br />Payment Schedule provided below. <br />9. Absent written permission from CDEC, Provider is prohibited from increasing the number of <br />available seats within a licensed location by more than twenty (20) percent (%) from the start of <br />registration, which is defined as when Provider has entered their program information and number of <br />available seats into the Colorado Preschool Program's Application System, and Provider's profile in <br />the Colorado Preschool Program's Application System containing said information has been published <br />for the first time for families applying for the 2025-2026 program year. Upon receipt of a written <br />request from Provider, CDEC shall allow Provider to increase their number of available seats by more <br />than twenty (20) percent (%) if the increase is reasonably related to either Provider maintaining <br />compliance with any applicable law regarding the education of children with disabilities, or is due to <br />an increase in the licensed capacity of Provider. Approval of a request to increase the number of <br />available seats by more than twenty (20) percent (%) within a licensed location for any other reason <br />shall be at CDEC's sole discretion. <br />Reporting Requirements <br />Provider agrees to adhere to all deadlines and submit documents as required or requested by <br />CDEC in order for CDEC to effectuate the Colorado Preschool Program in compliance with <br />state and federal law. Documents, which may include, but are not limited to, attendance <br />records, enrollment records, suspension and expulsion records, annual calendars, bell <br />schedules, hours of operation, tuition schedules, and detailed expense reports, must be retained <br />for verification and payment authorization, and must be provided to CDEC upon request within <br />5 Business Days. Provider is responsible for ensuring that all contact information related to the <br />program, including but not limited to the Program Director, Finance Director or CFO, CEO, <br />President, Authorized Representative, Quality Director or other leadership positions pertinent <br />to the operations of the program, is kept up-to-date, as necessary upon changes, with CDEC in <br />the Colorado Preschool Program Application System and via CDEC through a google form as <br />necessary upon changes, and provide any updated contact information monthly. No updates are <br />required in situations where no changes have occurred. CDEC, at its sole discretion, may <br />request other documentation if required to implement the Colorado Preschool Program, which <br />must be provided in five business days. <br />1. Provider agrees to submit: <br />i. any additional and case -by -case specific documentation required to effectuate the <br />Payment Schedule as laid out herein; <br />ii. Monthly and or quarterly reports utilizing the templates attached to this Contract as <br />Exhibit C regarding registration, enrollment, verification of a child's eligibility status, staff <br />compensation, the delivery of services and expenditures <br />iii. The quarterly reports will be submitted by the Provider by December 31 st, March 31 st, <br />June 30th. The quarterly reports shall be submitted through a system designated by CDEC. <br />Exhibit A Page 3 of 8 <br />30 <br />
