resolutions thereof by ENGINEER is acceptable to BIDDER, and that the Contract Documents <br />are generally sufficient to indicate and convey understanding of all terms and conditions for <br />performing and furnishing of the Work. <br />4.7 The provisions of 4.1 through 4.7 of this section, inclusive, do not apply to Asbestos, <br />Polychlorinated biphenyls (PCBs), Petroleum, Hazardous Waste, or Radioactive Material <br />covered by paragraph 4.5 of the General Conditions. <br />5. Availability of Lands for Work, Etc. <br />5.1 The lands upon which the Work is to be performed will be in the confines of street rights -of - <br />way and public property. All additional lands and access thereto required for temporary <br />construction facilities or storage of materials and equipment are to be obtained and paid for <br />by CONTRACTOR. Easements for permanent structures or permanent changes in existing <br />facilities are to be obtained and paid for by OWNER unless otherwise provided in the Contract <br />Documents. <br />6. Interpretations and Addenda <br />6.1 All questions about the meaning or intent of the Bidding Documents are to be submitted in <br />writing to the ENGINEER. Interpretation or clarifications considered necessary by ENGINEER in <br />response to such questions will be issued only by Addenda mailed or delivered to all parties <br />recorded by ENGINEER as having received Bidding Documents. Questions received less than <br />ten days prior to the date for opening of Bids may not be answered. Only questions answered <br />by formal written Addenda will be binding. Oral and other interpretations or clarifications will <br />be without legal effect. <br />6.2 Addenda may also be issued to modify the Bidding Documents as deemed advisable by <br />ENGINEER. <br />7. Bid Security <br />7.1 Each Bid must be accompanied by a Bid Security consisting of a properly Certified Check, <br />Cashier's Check, or Bid Bond on the form enclosed herewith, in the amount of five (5) percent <br />of BIDDER's Total Bid Price, without conditions, payable to the City of Louisville, Colorado. The <br />Bid Bond must be executed by a surety meeting the requirements of Paragraph 5.3 of the <br />General Conditions. The cost of the Bid Security shall be included in the bid. The submission of <br />the Bid and Bid Security is a pledge by the BIDDER that he will enter into an Agreement with <br />the Owner on the terms stated in his Bid and will, if required, furnish required insurance <br />certificates and bonds, covering the faithful performance of the Agreement and the payment <br />of all obligations arising thereunder. <br />7.2 The Bid Security of the Successful BIDDER will be retained until such BIDDER has executed the <br />Agreement, furnished the required contract security and met the other conditions of the <br />Notice of Award, whereupon the Bid Security will be returned. If the successful BIDDER fails to <br />execute, enter into or deliver an Agreement in accordance with an accepted bid proposal, or <br />fails to furnish the required bonds or certificates, within ten (10) days from the mailing of the <br />Notice of Award, or if the BIDDER has been guilty of collusion with other BIDDERS in submitting <br />the Bid, the OWNER may annul the Notice of Award and the Bid Security shall be forfeited to <br />13 <br />2025 WATER MAIN REPLACEMENT PROJECT & SANITARY SEWER BACKWATER PREVENTER VALVE PROJECT <br />Invitation to Bid <br />45 <br />
