<br /> RESOLUTION NO. ~ <br /> Series 1983 <br /> A RESOLUTION OPPOSING THE <br /> PROPOSED HOUSE BILL 1041 <br /> REGULATIONS RELATIVE TO <br /> WATER AND SANITATION SERVICES <br /> WHEREAS, the City of Louisville presently provides water and/or <br />sanitation services to major portions of Boulder County; and, <br /> WHEREAS, the Boulder County Land Use Department has, pursuant to <br />authority apparently granted to Colorado counties by C.R.S. 1973, ~24-65.l-l0l <br />et. ~. (also known as "House Bill 1041", 1974 Session), prepared draft regula- <br />tions concerning Site Selection and Construction of Major New Domestic Water and <br />Sewage Treatment Systems, or Major Extensions of Existing Domestic Water and <br />Sewage Treatment Systems; and, <br /> WHEREAS, the permit system contemplated by the draft regulations <br />would be adopted by Boulder County with the intent of effecting a major change <br />in the legal relationship which has existed for many years between the county <br />and entities providing water and sewer services within Boulder County; and, <br /> WHEREAS, it is believed that such action by Boulder County will not <br />serve the purposes and intents announced in the draft regulations, specifically <br />the intent to ensure that new systems or major extensions of existing systems <br />comply with the Boulder County Comprehensive Plan; and, <br /> WHEREAS, the City Council of the City of Louisville further believes <br />that if the draft regulations are adopted they will create great uncertainty <br />as to the ability of Boulder County municipalities to implement their comprehensive <br />plans which were prepared pursuant to C.R.S. 1973, 931-23-306 in reliance upon <br />the historic relationship between said municipalities and Boulder County, particularly <br />with respect to implementation of utility plans which are vital to such planning; <br />and, <br /> WHEREAS, it is believed that the creation of such uncertainty is <br />antagonistic to the goal shared by Boulder County and the City of Louisville <br />to encourage the consummation of intergovernmental agreements relating to county- <br />wide comprehensive planning; and, <br /> WHEREAS, the present manner of review of water and sewer projects by <br />Boulder County has been very successful in guiding the applicants and the county <br />
