RESOLUTION NO. 82 <br />SERIES 2025 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE <br />COLORADO DEPARTMENT OF TRANSPORTATION CONCERNING A GRANT IN <br />CONNECTION WITH THE CITY'S CO42 BIKE/PEDESTRIAN UNDERPASS AT SOUTH <br />STREET PROJECT <br />WHEREAS, the State of Colorado through the Colorado Department of <br />Transportation, ("CDOT") administers federal funds and grants under the Surface <br />Transportation Improvement Program for local transportation programs; and <br />WHEREAS, the City of Louisville has applied for and been awarded a grant for the <br />design and construction of a bike/pedestrian underpass under CO42 at South Street, <br />subject to the execution of an Intergovernmental Agreement for the grant; and <br />WHEREAS, the City desires to accept such grant and authorize execution of a grant <br />contract for such funds. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City Council hereby accepts the grant in the amount of <br />$1,900,000.00 (the "Grant") from the State of Colorado, Department of Transportation, to <br />be used in the design and construction of the City's CO42 Bike/Pedestrian Underpass at <br />South Street Project, Project No. STU M825-018 (26013) (the "Project"). <br />Section 2. The City Council hereby approves that certain Intergovernmental <br />Agreement (the "Agreement") by and between the State of Colorado, acting by and through <br />the Colorado Department of Transportation, and the City of Louisville, for the Grant awarded <br />to the City for the Project, in substantially the same form as the copy of such Agreement <br />accompanying this Resolution. <br />Section 3. The Mayor and City Clerk are hereby authorized to execute the <br />Agreement on behalf of the City Council of the City of Louisville, and the Mayor is hereby <br />further authorized to negotiate and approve such revisions to the Agreement as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the Agreement are not altered. <br />Section 4. The Mayor, City Manager, and City Staff are hereby authorized and <br />directed to do all things necessary on behalf of the City to perform the obligations of the City <br />under the Agreement, including without limitation that the Mayor or City Manager are <br />authorized to execute and deliver any certifications, reports, forms, option letters, contract <br />amendments and other documents appropriate or required in connection with the <br />Resolution No. 82, Series 2025 <br />Page 1 of 2 <br />
