INTERGOVERNMENTAL AGREEMENT FOR SHARING OF COSTS OF 30% DESIGN <br />FOR IMPROVEMENTS TO STATE HIGHWAY CO-42 FROM PASCHAL DRIVE TO <br />BASELINE ROAD <br />THIS AGREEMENT is made this 3.00 day of November , 2025 by and <br />between the City of Lafayette, a Colorado home rule municipality ("Lafayette"), and the <br />City of Louisville, a Colorado home rule municipality ("Louisville"), each a "Party" and <br />collectively the "Parties." <br />WHEREAS, the Parties are authorized by § 29-1-203, C.R.S. as amended, to enter <br />into contracts or agreements for the sharing of costs; and <br />WHEREAS, C.R.S. § 29-1-201, et seq., authorizes and encourages local <br />governments to make the most efficient and effective use of their powers and <br />responsibilities by cooperating and contracting with one another to provide any function, <br />service, or facility lawfully authorized to each; and <br />WHEREAS, in accordance with § 29-1-203, C.R.S. as amended, each of the <br />Parties is authorized to enter into this Agreement; and <br />WHEREAS, the Parties desire to complete a plan and initial design for that portion <br />of the State Highway 42 corridor extending between Paschal Drive in Louisville and <br />Baseline Road in Lafayette (the "Plan"); and <br />WHEREAS, the Plan is intended to examine the road cross section, multi -modal <br />facilities , stormwater and drainage facilities and electric and underground utilities; and <br />WHEREAS, the Plan will complete preliminary design (30%) for the corridor; and <br />WHEREAS, Louisville has requested and received CDOT 10-year Strategic <br />Project Pipeline funds in the amount of $870,000 to complete the Plan (the "Grant"), and <br />has entered into a grant agreement with the Colorado Department of Transportation <br />("CDOT") setting forth the terms of the Grant; and <br />WHEREAS, the Grant does not require local matching funds; and <br />WHEREAS, the Parties desire to enter into an IGA to confirm their intent to <br />undertake the Plan; to identify the allocation of the cost of any design work in excess of <br />$870,000 for the Plan; to establish the process by which such allocation and payment will <br />be accomplished; to set forth the agreement by the Parties as to the role of Louisville as the <br />lead agency and executor of the Grant; and to acknowledge the Parties' intent to enter into <br />a future agreement or an amendment to this Agreement if and when the costs exceed <br />what is expected. <br />
