ORDINANCE NO. 1909 SERIES 2025 AN ORDINANCE AUTHORIZING THE SALE AND CONVEYANCE OF THE CITY - OWNED PROPERTY AT 1016 MAIN STREET WHEREAS, the City of Louisville is the owner of the real property located at 1016 Main Street, Louisville, Colorado and legally described as Lot 10, Block 17, CALEDONIA PLACE, County of Boulder, State of Colorado (the "Property"),- and WHEREAS, the Property, which contains a historic home, was acquired with Historic Preservation Funds as a historic property contributing to the historic character of the City; and WHEREAS, the Property is not needed and is not being held or used for any park, open space, municipal or governmental purposes; and WHEREAS, the City Council desires to sell the Property and pursuant to Resolution No. 75, Series 2025, the City Council approved a Contract to Buy and Sell Real Estate (the "Purchase Contract") for the sale of the Property to Marike and Gregory Fitzgerald for $1.4 million on the condition that the Property receive historic landmark designation prior to closing; and WHEREAS, pursuant to C.R.S. § 31-15-713, the City Council desires to authorize the sale and conveyance of the Property in accordance with the terms and conditions of the Purchase Contract; and WHEREAS, the City Council has determined it is in the best interest of the City and its citizens to sell and convey the Property upon the terms and conditions set forth herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City Council hereby approves and authorizes the sale and conveyance of the Property from the City to Marike and Gregory Fitzgerald (the "Purchaser") for a purchase price of $1.4 million. Section 2. The sale and conveyance of the Property shall be upon the terms and conditions set forth in the Purchase Contract between the City and the Purchaser, which was approved by City Council Resolution No. 75, Series 2025, and the terms and conditions of which are incorporated herein by reference as though set forth in full. Section 3. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid.
