ORDINANCE NO. 1909 <br />SERIES 2025 <br />AN ORDINANCE AUTHORIZING THE SALE AND CONVEYANCE OF THE CITY - <br />OWNED PROPERTY AT 1016 MAIN STREET <br />WHEREAS, the City of Louisville is the owner of the real property located at 1016 <br />Main Street, Louisville, Colorado and legally described as Lot 10, Block 17, CALEDONIA <br />PLACE, County of Boulder, State of Colorado (the "Property"),- and <br />WHEREAS, the Property, which contains a historic home, was acquired with Historic <br />Preservation Funds as a historic property contributing to the historic character of the City; <br />and <br />WHEREAS, the Property is not needed and is not being held or used for any park, <br />open space, municipal or governmental purposes; and <br />WHEREAS, the City Council desires to sell the Property and pursuant to Resolution <br />No. 75, Series 2025, the City Council approved a Contract to Buy and Sell Real Estate (the <br />"Purchase Contract") for the sale of the Property to Marike and Gregory Fitzgerald for $1.4 <br />million on the condition that the Property receive historic landmark designation prior to <br />closing; and <br />WHEREAS, pursuant to C.R.S. § 31-15-713, the City Council desires to authorize <br />the sale and conveyance of the Property in accordance with the terms and conditions of the <br />Purchase Contract; and <br />WHEREAS, the City Council has determined it is in the best interest of the City and <br />its citizens to sell and convey the Property upon the terms and conditions set forth herein. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City Council hereby approves and authorizes the sale and <br />conveyance of the Property from the City to Marike and Gregory Fitzgerald (the <br />"Purchaser") for a purchase price of $1.4 million. <br />Section 2. The sale and conveyance of the Property shall be upon the terms and <br />conditions set forth in the Purchase Contract between the City and the Purchaser, which <br />was approved by City Council Resolution No. 75, Series 2025, and the terms and conditions <br />of which are incorporated herein by reference as though set forth in full. <br />Section 3. If any portion of this ordinance is held to be invalid for any reason, <br />such decision shall not affect the validity of the remaining portions of this ordinance. The <br />City Council hereby declares that it would have passed this ordinance and each part <br />hereof irrespective of the fact that any one part be declared invalid. <br />Ordinance No. 1909, Series 2025 <br />Page 1 of 2 <br />
