In the event the CTC District does not construct road improvements, the Subdivider shall <br />be obligated to construct road improvements for Cherry Street and South 104th. The full <br />length of Cherry Street shall be constructed in Phase I. South 104th shall be constructed <br />prior to the issuance of building permits in Phase II. The Subdivider shall be required to <br />execute a development agreement and secure same with the required guarantee in a form <br />acceptable to the City prior to the issuance of building permits in the respective phases. <br /> <br />Subdivider shall convey the 54-foot easement parcel adjacent to South 104th Street by <br />conservation easement deed at or prior to the recording of the Final Subdivision Plat. <br /> <br />This approval shall be contingent upon the details of the Maple Grove Water Systems' <br />issues being satisfactorily resolved to the satisfaction of Staff and the Mayor <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that, subject to the above conditions, the City <br />Council does hereby approve the Final Subdivision Plat and PUD Development Plan for the Park <br />at CTC. <br /> <br /> PASSED AND ADOPTED this 31st day of March 1998. <br /> <br />Tom Davidson, Mayor <br />City of Louisville, Colorado <br /> <br />Dave Clabots, City Clerk <br /> <br /> <br />
