Colorado Revised Statutes § 30-15-401(1)(n.5) authorizes the Board of County <br />Commissioners of the County of Boulder ("Board") to impose fire restrictions and to ban <br />open fires within the unincorporated areas of Boulder County when the danger of <br />wildfire, forest or grass fires is found to be high; <br />B. Colorado Revised Statutes § 30-15-401(1)(n.7) authorizes the Board of County <br />Commissioners of Boulder County to prohibit or restrict the sale, use, and possession of <br />fireworks within the unincorporated areas of Boulder County; <br />C. Boulder County Ordinance 2023-1 states that the Board of County Commissioners of the <br />County of Boulder or the Boulder County Sheriff ("Sheriff") shall, whenever the danger <br />of forest or grass fires is found to be high, have the authority to declare a ban on open <br />fires, which ban may prohibit persons from engaging in any activity that produces or <br />maintains, or that attempts to produce or maintain, a spark, flame, or ignition source, and <br />a ban on the sale and use of fireworks; <br />D. Competent evidence, including qualitative and quantitative data produced by the National <br />Weather Service and the National Fire Danger Rating System, indicates high fire danger <br />conditions for unincorporated Boulder County and includes: <br />a. 1000 hr fuels: <12% <br />- Current sampled 1000-hr fuel moistures are at 12% as of 12/08/2025 <br />b. Burning Index: >80th percentile <br />- Burning Index has been and is predicted to stay between the 80`" and 90th <br />percentile or greater. <br />c. Above -average warm and dry conditions anticipated for the extended forecast <br />- Near record temperatures for this time of year and relative humidity in the <br />low teens to single digits. <br />d. The seasonal continuation of moderate to severe drought conditions throughout <br />Colorado which can cause fires to grow quickly <br />- All of Boulder County is in D 1 Moderate drought <br />e. Exceptionally dry fine fuels on the plains with little to no moisture in sight <br />through New Years brings potential for large fire growth on windy days to maximum <br />levels for concern. <br />1 <br />
