RESOLUTION NO. 9 <br />SERIES 1998 <br /> <br /> A RESOLUTION APPROVING <br /> A FINAL SUBDIVISION PLAT, <br /> FINAL PUD DEVELOPMENT PLAN <br /> AND SPECIAL REVIEW USE <br />FOR CLARE BRIDGE ALTERNATIVE LIVING SERVICE <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council by DelCare, Inc. a <br />request for approval of a Final Subdivision Plat, Final PUD Development Plan and Special <br />Review Use (SRU) for a Alzheimer's and Dementia Care Facility to be known as Clare Bridge; <br />and <br /> <br /> WHEREAS, all materials related to the Final Subdivision Plat, Final PUD Development <br />Plan and SRU have been reviewed by City Staff and the Planning Commission and found, with <br />conditions, to be in compliance with the Louisville zoning ordinances, subdivision regulations, <br />and related policies; and <br /> <br /> WHEREAS,after a properly advertised public hearing concerning said Final Subdivision <br />Plat, Final PUD Development Plan and SRU the Planning Commission recommended approval <br />with conditions to the City Council; and <br /> <br /> WHEREAS, the City Council finds that said Final Subdivision Plat, Final PUD <br />Development Plan and SRU for the Clare Bridge Alternative Living Services should be approved, <br />with the following conditions: <br /> <br />That the applicant agrees to formalize the commitment to participate in possible future <br />funding of McCaslin interchange improvements, including acknowledgment that they will <br />not protest inclusion in a possible special improvement district on the grounds that their <br />property does not benefit by such improvements, with language to be incorporated into a <br />note on the Plat and in the subdivision agreement that is subject to approval by the City <br />Attorney, City Administrator, Applicant and Mayor; <br /> <br />That the applicant and staff reach agreement on the placement and separation of the brick <br />fence columns along the south property line to be incorporated into the PUD. <br /> <br />o <br /> <br />That it is noted on the PUD that the siding on the trash enclosure will be painted to match <br />the building; <br /> <br /> <br />
