if Council finds that the property is eligible for annexation, they would make those <br />findings by Resolution No. 33, Series 1999, and Council would annex the property by <br />Ordinance No. 1301, Series 1999. He explained that since the public hearings for each of <br />those items bears on the merits of the proposed annexation, he recommends that upon <br />opening the public hearing on Resolution No. 33, Series 1999, Council accepts any <br />comment on any of the four Agenda items, including the annexation and zoning of the <br />property. <br /> <br />Davidson opened the public hearing on Resolution No. 33, Series 1999 - A Resolution <br />Concerning A Petition For The Annexation Of Property To The City Of Louisville <br />Warembourg Ranch and any of the subsequent Ordinances. He called for anyone in the <br />audience who wishes to speak in favor or against Resolution No. 33, Series 1999. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments and questions. <br /> <br />Mayer asked for clarification that Council is considering the Agenda items as a group. <br /> <br />Davidson replied, yes. <br /> <br />Light suggested that the public hearing be left open for any further discussion of the <br />zoning of the property. <br /> <br />Davidson reopened the public hearing. <br /> <br />Mayer stated that page four of the Annexation Agreement reads: 'This Agreement shall be <br />null and void if the City fails to approve the annexation of the property on or before April <br />14, 2000.' He does not have any objections to that, however, he questioned why it <br />shouldn't be made binding on both parties. <br /> <br />Light explained that the petition has already been filed and is before Council. The April <br />14, 2000, date is the 'drop-dead' date under the purchase contract. <br /> <br />Mayer asked for clarification that the annexation would go forward if the City executes <br />the documents. <br /> <br />Light replied, yes. He stated that if the petitioner attempted to withdraw their annexation <br />petition tonight, City Council would simply have the option of not approving and <br />executing the Annexation Agreement and not passing the Ordinances to zone and annex <br />the property. <br /> <br />Sisk asked Wood for a map showing the property to be annexed, as he did not locate one <br />in the Council packet. <br /> <br />Wood apologized for the oversight. <br /> <br />4 <br /> <br /> <br />
