RESOLUTION NO. 35, SERIES 1999 - A RESOLUTION APPROVING A FINAL <br />SUBDIVISION REPLAT AND A FINAL PUD DEVELOPMENT PLAN FOR <br />LOTS 2, 3, 4 AND 5, BLOCK 2, THE BUSINESS ENTER AT CTC, REPLAT B <br /> <br />Davidson called for staff presentation. <br /> <br />Paul Wood, Planning Director, stated that this is a request for approval of a subdivision <br />replat and final PUD development plan to allow the construction of three speculative <br />multi-tenant, 'flex', industrial/R & D buildings in the Business Center at CTC. The <br />property is zoned PCZD as part of the Business Center at CTC General Development <br />Plan. This subarea is approved for those uses listed as permitted uses in the Industrial <br />zoning district of the City. The site is currently undeveloped and does not have full street <br />access, though the adjacent streets are scheduled to be completed this summer. <br /> <br />This application was reviewed as a preliminary plat and preliminary PUD by City <br />Council on January 19 of this year. At that time, both Staff and Council expressed <br />concerns with the broad scope of flexibility requested in regards to types of users, <br />parking, loading doors, architecture and phasing. A preliminary PUD and plat was <br />subsequently reviewed and conditionally approved by the Planning Commission. The <br />Commission on June 8 approved the final plat and PUD by Resolution #28, Series 1999. <br />The 24 conditions of approval have been Substantially addressed. The remaining <br />conditions are generally not substantive and relate to issues that would typically be <br />finalized after final City Council action. <br /> <br />The replat request is a proposal to shift property lines and add an outlot to be used for <br />common stormwater detention. The dePths of Lots 2, 3 and 4 are increased and the size of <br />Lot 5 gets correspondingly smaller. Cross access is proposed between all lots, including <br />Lot 5, though the final design of the access to Lot 5 would be reviewed during the PUD <br />review of that property. <br /> <br />Various new public and private easements are proposed with the replat. After recording <br />the new plat the existing easements from the original plat will need to be vacated by <br />separate Council ordinance. The City will also review the wording in the cross access <br />easement and the Outlot M maintenance declaration, both of which will be recorded with <br />Boulder County. <br /> <br />Staff has requested some utility easement stub outs to adjacent properties to the east and <br />south. The applicant has provided one utility stub out to Lot 5, to the east. Staff would <br />request two additional utility stub outs: one additional one to Lot 5, immediately north of <br />Outlot M, and one to the south, approximately 150 feet west of the southeast corner of <br />Lot 2. A PUD has been approved for the lot to the south, however, since the development <br />of that project is still questionable, Staff would like to preserve the opportunity for utility <br />connections in the event a different proposal is made on that property in the Park at CTC. <br /> <br /> <br />
