<br />RESOLUTION NO.4 <br />SERIES 2004 <br /> <br />A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY <br />AND SELL VACANT REAL EST ATE FOR PARK AND RIGHT -OF-WAY PURPOSES <br /> <br />WHEREAS, the City of Louisville desires to acquire, for park and right-of-way purposes, <br />approximately 3.5 acres of property owned by Bruce R. Savage and Illene C. Savage; and <br /> <br />WHEREAS, the property consists of parcels that lie within unincorporated Boulder <br />County, in the Southwest One-Quarter of Section 8, Township 1 South, Range 69 West of the 6th <br />P.M., north of Spruce Street between the eastern and western ends of Walnut Street, and in the <br />vicinity of the Treehaven, McKinley Park and Louisville Heights subdivisions, as more particularly <br />described in the Purchase Contract accompanying this Resolution (the "Property"); and <br /> <br />WHEREAS, the owners of the Property have stated their desire to sell the Property to <br />Louisville upon the terms and conditions of a mutually-agreeable purchase contract; and <br /> <br />WHEREAS, a Purchase Contract has been proposed with the owners for purchase of the <br />Property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />1. The proposed Purchase Contract to Buy and Sell Real Estate between the City and <br />Bruce R. Savage and Illene C. Savage is hereby approved in essentially the same form as the copy <br />of such Purchase Contract accompanying this Resolution. <br /> <br />2. The Mayor is authorized to execute the Purchase Contract, except that the Mayor is <br />hereby granted the authority to negotiate and approve such revisions to said Contract as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of the Contract are not altered. <br /> <br />3. The Mayor, City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under the Purchase Contract, <br />and are further authorized to execute and deliver any and all documents necessary to effect the <br />purchase of the Property under the terms and conditions of said Purchase Contract. <br /> <br />PASSED AND ADOPTED this 20th day of January, 2004. <br /> <br /> <br />1 <br />
