The uses of the Property shall be limited to the <br /> following, which are considered to be permitted under this Easement subject to the provisions <br /> hereof: <br /> 2.1 Continuation of the existing uses, buildings and structures upon the Property, as <br /> described and depicted on Exhibit 2, attached hereto and incorporated herein by <br /> reference(the "Existing Uses"), subject to and consistent with the provisions of the <br /> Louisville Municipal Code regarding nonconforming uses and structures,as may be <br /> amended and in effect from time to time. <br /> 2.2 Agriculture uses, limited solely to agricultural or commercial crop or animal <br /> production. <br /> 2.3 One single-family dwelling, only upon cessation of the Existing Uses and with a <br /> density of no more than one unit per five acres. Owner acknowledges that the <br /> Property would need to be combined with other properties, or an amendment to the <br /> INTERGOVERNMENTAL AGREEMENT would need to be obtained,prior to any <br /> residential use of the Property. <br /> 2.4 In the event of a direct conflict between the provision of this Easement and the terms <br /> or provisions of the City zoning ordinance, this Easement shall control. <br /> 2.5 Access to the Property shall be limited to one driveway access located off of South <br /> 104th Street. <br /> 2.6 Owner shall be responsible for obtaining any future permits or approval required for <br /> the permitted uses, in accordance with the criteria applicable to such permits or <br /> approvals. The permitted uses shall be conducted in accordance with all generally <br /> applicable City ordinances. <br /> 3. Prohibited Uses.The following uses and practices are inconsistent with the spirit and <br /> purposes of this Easement and are prohibited upon or within the Property: <br /> 3.1 Any use other than those expressly permitted under Section 2, above, or any use <br /> inconsistent with the spirit and purposes of this Easement. <br /> 3.2 The construction or reconstruction of any building or other structure,excepting those <br /> existing on the date of this Easement and those set forth in Subsections 3.2.1 and <br /> 3.2.2. <br /> 3.2.1 Existing fences may be repaired and replaced and new fences may be built <br /> anywhere on the Property for reasonable management of those uses permitted under <br /> Section 2, above. <br /> 2 <br />
