Page 11 <br /> 11111111111111111111111111111111111111011111111111111 2773464 <br /> 2308P <br /> Boulder County Clerk, CO AG R 216 00 D 0 00 <br /> Exhibit A —Form of Vacation Ordinance <br /> ORDINANCE NO. <br /> SERIES 2006 <br /> AN ORDINANCE APPROVING THE VACATION OF PORTIONS OF THE <br /> SOUTH FRONT STREET RIGHT-OF-WAY LOCATED BETWEEN LOTS <br /> 16 AND 17, BLOCK 8 AND LOTS 10 AND 11, BLOCK 9 IN THE MURPHY <br /> PLACE SUBDIVISION IN THE CITY OF LOUISVILLE; AUTHORIZING <br /> THE EXECUTION OF QUIT CLAIMS DEEDS IN CONNECTION WITH <br /> SUCH VACATION, AND APPROVING AND AUTHORIZING THE <br /> EXECUTION OF A GRANT OF EASEMENTS AND AGREEMENT FOR <br /> TEMPORARY OCCUPANCY OF THAT PORTION OF SUCH RIGHT-OF- <br /> WAY NOT SUBJECT TO VACATION. <br /> WHEREAS, by the plat of the Murphy Place Subdivision, recorded in 1907 as Reception <br /> No. 57381, Plat Book 3, Page 28, Boulder County Records, there was dedicated to the City a right- <br /> of-way sixty (60) feet wide and fifty (50) feet in length located between Lots 16 and 17, Block 8 <br /> (which Lots are owned by Philip and Denise Ehrmann and known as 221 Front Street) and Lots 10 <br /> and 11,Block 9 (which Lots are owned by Kenneth and Bernadine Sawyer and known as 224 Front <br /> Street); and <br /> WHEREAS, ownership of such right-of-way is the subject of pending litigation between <br /> the adjoining landowners and the City,which litigation is styled as Kenneth E. Sawyer, et al. v. City <br /> of Louisville, Civil Action No. 2005CV52,Boulder County District Court,Division 12; and <br /> WHEREAS, as part of settlement of this litigation, it has been proposed that the City retain <br /> a portion of the right-of-way and vacate those portions of the right-of-way lying east and west of the <br /> City-retained portion; and <br /> WHEREAS, in particular, it has been proposed that the City not vacate and retain that <br /> portion of the right-of-way described on Exhibit A, Item A-1 (the "Center Portion - South Front <br /> Street Right-of-Way"), and that the City vacate the eastern and western portions of the right-of-way <br /> as described,respectively, on Exhibit A, Item A-2 (the"Eastern Portion—South Front Street Right- <br /> of-Way") and Exhibit A, Item A-3 (the"Western Portion—South Front Street Right-of-Way"); and <br /> WHEREAS, in connection with such partial vacation of the right-of-way, there has been <br /> proposed an exchange of quit claims deeds among the above-referenced landowners and the City,to <br /> convey to the City any interest of such landowners in the Center Portion—South Front Street Right- <br /> of-Way; to convey to the Sawyers any interest of the City in the Eastern Portion — South Front <br /> Street Right-of-Way; and to convey to the Ehrmanns any interest of the City in the Western Portion <br /> —South Front Street Right-of-Way; and <br />
