<br /> RESOLUTION NO. 14 <br /> SERIES 2006 <br /> A RESOLUTION APPROVING <br />A FINAL SUBDIVSION PLAT AND A PUD DEVELOPMENT PLAN FOR <br /> THE GARBO SUBDIVISION <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final subdivision plat and a final pun development plan for a two lot residential <br />subdivision known as the Garbo Subdivision; and <br />WHEREAS, all materials related to the final subdivision plat and final PUD <br />development plan have been reviewed by City Staff and the Planning Commission and found, <br />to be in compliance with the Louisville zoning ordinances, subdivision regulations, and related <br />policies and previous approvals; and <br />WHEREAS, after a duly noticed public hearing concerning said final subdivision plat <br />and final PUD development plan on March 9,2006, where evidence and testimony were <br />entered into the public record, including the Staff Report dated March 9, 2006, the Planning <br />Commission recommended approval to the City Council, with one condition; and <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and finds that the application should be approved, with one <br />condition, as follows: <br />1. The property owner shall convey a deed of easement to the adjoining property owner at 109 <br />W. Spruce Street for the structural encroachment and an associated maintenance easement. <br />The deed of easement shall be recorded prior to or in conjunction with the recordation of the <br />final subdivision plat. <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Louisville, Colorado does hereby approve a final subdivision plat and a final PUD <br />development plan for the Garbo Subdivision. <br />ASSED AND ADOPTED this 21 st day of March 2 06 <br /> BY: <br /> Charles 'sk, ayor <br /> City of Louisville, Colorado <br />Nancy Varra, City Clerk <br />City of Louisville, Colorado <br />
