• III1IIIIIIIIIIIIIIIIIII1IIIIIIIIIIIII�IIIIIIIIIIIIIIIII ff4?8!1?9 Boulder County Clerk, CO RG R 47.00 D 0.0.0 ® INTERGOVERNMENTAL AGREEMENT REGARDING CIMARRON DRIVE This Intergovernmental Agreement (the "Agreement") is between the City of Lafayette,. a Colorado home rule municipality("Lafayette"); and the City of Louisville, a Colorado home rule municipal corporation ("Louisville"), collectively the "Parties"; regarding road and street right- of-way maintenance, and street signalization is made to be effective on the L4. - day of 'Tote , 2006. RECITALS 1. A section of Cimarron.Drive, located south of So. Boulder Road, is proposed to • be constructed so that the roadway's centerline aligns generally with the city limits line between Lafayette and Louisville; thereby causing approximately one-half(1/2) of the Cimarron Drive roadway being constructed within the city limits of Lafayette and the other half being constructed within the city limits of Louisville; and 2. The Parties desire to enter into an agreement to establish maintenance responsibilities for this section of Cimarron Drive; and 3. The Parties desire to enter into an agreement to share the cost of the road maintenance for this section of Cimarron Drive; and 4. The Parties desire to enter into an agreement to share the cost of a traffic signal at the intersection of Cimarron Drive and So. Boulder Road; AGREEMENT In consideration of the terms and provisions herein,the Parties agree as follows: I. This Agreement shall apply to all public iniprovernents within that portion of the Cimarron Drive right-of-way that traverses and overlaps the city limits of both Parties as depicted in Exhibit A(hereinafter the"Cimarron Drive Roadway"). • a. For the purpose of this Agreement "Joint Public Improvements" shall include, roadway pavement, road base and sub-grade preparation, curb and gutters; stormwater drainage improvements and traffic control devices other than street lights within the Cimarron Drive Roadway. b. For the purpose of this Agreement "Additional Public Improvements" shall include, but are not limited to, sidewalks, street lights and landscaping within the Cimarron Drive Roadway: c. Lafayette shall,.at its sole expense, maintain all Joint Public htiprovements within the Cimarron Drive Roadway until such time as any existing or future development with the city limits of Louisville connects with the Cimarron Drive ® Roadway. •
