<br /> RESOLUTION NO. 26 <br /> SERIES 2006 <br /> APPROVAL OF A FINAL SUBDIVISION REPLAT FOR LOTS 4 AND 5 OF THE <br /> AL VENUS SUBDIVISION, AND A FINAL PUD DEVELOPMENT PLAN FOR <br /> 107,875 SQUARE FEET OF DEVELOPMENT IN A THREE-STORY, SENIOR, <br /> INDEPENDENT LIVING FACILITY AND 17,398 SQUARE FEET OF <br /> DEVELOPMENT FOR A TWO STORY INDEPENDENT LIVING FACILITY. <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br /> approval of a final subdivision replat for Lots 4 and 5 of the Alvenus Subdivision, and a Final <br /> PUD development plan for 107,875 square feet of development in a three-story, senior <br /> independent living facility and 17,398 square feet of development for a two story independent <br /> living facility; and <br /> WHEREAS, all materials related to the final subdivision replat and final PUD <br /> development plan have been reviewed by City Staff and the Planning Commission and found, <br /> to be in compliance with the Louisville zoning ordinances, subdivision regulations, the <br /> Commercial Development Design Standards and Guidelines, related policies and previous <br /> approvals; and <br /> WHEREAS, after a duly noticed public hearing concerning said final subdivision replat <br /> and final PUD development plan on May 11, 2006 where evidence and testimony were <br /> entered into the public record, including the Staff Report dated May 11, 2006 the Planning <br /> Commission recommended approval to the City Council, with conditions; and <br /> WHEREAS, City Council has reviewed the application, including the recommendation <br /> of the Planning Commission and finds that the application should be approved subject to the <br /> following conditions: <br /> 1. That an ordinance vacating the access easement shared between Lots 4 and 5 shall be <br /> brought forward for review and action by the City Council prior to the issuance of a <br /> building permit. <br /> 2. The fire emergency fire lane shall be designed and constructed of a surface suitable to <br /> withstand the weight of the heaviest fire apparatus of the Louisville Fire Protection <br /> District. The applicant shall secure sign off from the Fire District of an engineered <br /> construction drawing of the proposed fire lane prior to the issuance of a building <br /> permit. <br /> 3. The PUD shall be revised to modify the proposed sidewalk on Hecla Drive from 5' to <br /> 6' in width. <br />
