RESOLUTION NO. 27 SERIES 2006 A RESOLUTION APPROVING AN AMENDMENT TO THE HIGHWAY 42 REVITALIZATION AREA COMPREHENSIVE PLAN. WHEREAS, there has been submitted to the Louisville City Council, a request to amend the Highway 42 Revitalization Area Comprehensive Plan; and WHEREAS, the City of Louisville is a home rule municipal corporation organized under and pursuant to Article XX of the Colorado Constitution and the Louisville Home Rule Charter; and WHEREAS, by virtue of such authority, and as further authorized by state statutes, including but not limited to c.R.S. SS 31-23-206 et seq. the City has broad authority to make and adopt a comprehensive plan for the physical development of the municipality; and WHEREAS, pursuant to such authorities, the City has adopted the Highway 42 Revitalization Comprehensive Plan, which Plan serves as a guiding document containing the policy framework under which new development and redevelopment within the Highway 42 Revitalization Area will be evaluated; and WHEREAS, all materials related to the Highway 42 Comprehensive Plan Amendment have been reviewed by City Staff and the Planning Commission and found, to be in compliance with the Louisville zoning ordinances, and related policies; and WHEREAS, after a duly noticed public hearing concerning said Highway 42 Comprehensive Plan Amendment on May 11, 2006 where evidence and testimony were entered into the public record, including the Staff Report dated May 11, 2006 the Planning Commission recommended approval to the City Council, without condition; and WHEREAS, City Council has reviewed the request, including the recommendation of the Planning Commission and finds that the Highway 42 Comprehensive Plan Amendment should be approved, without modification. NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Louisville, Colorado does hereby approve that the Highway 42 Comprehensive Plan Amendment.
