RESOLUTION NO. 28 SERIES 2006 A RESOLUTION ADOPTING UPDATED PUBLIC RECORDS REQUEST PROCEDURES AND FEES FOR THE CITY OF LOUISVILLE, AND DESIGNATING THE OFFICIAL CUSTODIANS OF CITY RECORDS WHEREAS, by the adoption of its home rule charter in 200 I and the adoption of Ballot Issue 200 in 2004, the City has established in its home rule charter certain policies and procedures regarding public records; arid WHEREAS, pursuant to the Colorado Public Records Act and the charter, the City Clerk arid City Manager have each previously promulgated a Public Records Policy for the City; and WHEREAS, the City Council finds it necessary and appropriate to adopt by resolution an updated set of Public Records Request Procedures and Fees so as to facilitate the implementation of Ballot Issue 200 and avoid confusion over the procedures and fees applicable to requests for public records; and WHEREAS, the Public Records Request Procedures and Fees herein adopted shall replace all prior versions of any City Public Records Policy previously adopted by resolution or administrative action. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. There is hereby adopted the attached City of Louisville Public Records Procedures and Fees statement. A copy of such statement as hereby adopted shall be placed in the Office of the City Clerk together with a certified copy of this Resolution. Section 2. The City Council hereby designates the City Clerk as the official custodian of all public records of the City, with the following exceptions: 1. The Chief of Police shall be the official custodian of criminal justice records as defined by C.R.S. 24-72-302; 2. The Humarl Resources Manager shall be the official custodian of personnel records; and 3. The Director of Finarlce shall be the official custodian of utility billing records. The duties of official custodian under state law shall be performed by the above-named official custodians, each with respect to the records for which they are herein designated as such custodian, or by such custodian's designee.
