<br /> RESOLUTION NO. 51 <br /> SERIES 2006 <br />A RESOLUTION APPROVING AN AMENDMENT TO THE U.S. 36 CORRIDOR <br />COMPREHENSIVE DEVELOPMENT ]>LAN INTERGOVERNMENTAL AGREEMENT <br />WHEREAS, the City of Louisville, the City of Boulder, the Town of Superior and the <br />County of Boulder, Colorado are parties to the Intergovernmental Agreement U.S. 36 Corridor <br />Comprehensive Development Plan, dated June 20, 2000, as amended by the First Amendment <br />thereto dated April 9, 2002 and the Willow Ranch TDR Amendment thereto dated October 16, <br />2003 (hereinafter the "Agreement"); and <br />WHEREAS, the parties desire to amend the Agreement by that certain proposed <br />amendment entitled "Amendment to Intergovernmental Agreement for u.S. 36 Corridor <br />Comprehensive Development Plan to Allow City of Louisville to Provide Water Service to Public <br />Service Company of Colorado's Foothills Gas Compressor Station Approved in Boulder County <br />Land Use Docket #SI-06-001" (hereinafter the "Foothills Gas Compressor Station Water Service <br />Amendment"), attached hereto; and <br />WHEREAS, the City is authorized to execute the proposed Foothills Gas Compressor <br />Station Water Service Amendment pursuant to C.R.S. S29-20-101 et seq., which authorizes the <br />parties to cooperate and contract with each other for the purpose of planning and regulating the <br />development of land by means of a "comprehensive development plan"; and <br />WHEREAS, pursuant to C.R.S. S29-20-105, the City Council has held a public hearing on <br />the proposed Foothills Gas Compressor Station Water Service Amendment after proper notice; and <br />WHEREAS, the City Council finds that the proposed Foothills Gas Compressor Station <br />Water Service Amendment is in the best interests of the City and its citizens. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. The proposed Amendment to Intergovernmental Agreement for U.S. 36 <br />Corridor Comprehensive Development Plan to Allow City of Louisville to Provide Water Service <br />to Public Service Company of Colorado's Foothills Gas Compressor Station Approved in Boulder <br />Land Use Docket #SI-06-001, ("Foothills Gas Compressor Station Water Service Amendment") a <br />copy of which is attached hereto and incorporated herein by this reference, is hereby approved. <br />Section 2. The Mayor is hereby authorized to execute the attached Foothills Gas <br />Compressor Station Water Service Amendment, on behalf of the City Council of the City of <br />Louisville, except that the Mayor is hereby further authorized to negotiate and approve such <br />revisions to the Foothills Gas Compressor Station Water Service Amendment as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of such Amendment are not altered. <br />
