RESOLUTION NO. 51 SERIES 2006 A RESOLUTION APPROVING AN AMENDMENT TO THE U.S. 36 CORRIDOR COMPREHENSIVE DEVELOPMENT ]>LAN INTERGOVERNMENTAL AGREEMENT WHEREAS, the City of Louisville, the City of Boulder, the Town of Superior and the County of Boulder, Colorado are parties to the Intergovernmental Agreement U.S. 36 Corridor Comprehensive Development Plan, dated June 20, 2000, as amended by the First Amendment thereto dated April 9, 2002 and the Willow Ranch TDR Amendment thereto dated October 16, 2003 (hereinafter the "Agreement"); and WHEREAS, the parties desire to amend the Agreement by that certain proposed amendment entitled "Amendment to Intergovernmental Agreement for u.S. 36 Corridor Comprehensive Development Plan to Allow City of Louisville to Provide Water Service to Public Service Company of Colorado's Foothills Gas Compressor Station Approved in Boulder County Land Use Docket #SI-06-001" (hereinafter the "Foothills Gas Compressor Station Water Service Amendment"), attached hereto; and WHEREAS, the City is authorized to execute the proposed Foothills Gas Compressor Station Water Service Amendment pursuant to C.R.S. S29-20-101 et seq., which authorizes the parties to cooperate and contract with each other for the purpose of planning and regulating the development of land by means of a "comprehensive development plan"; and WHEREAS, pursuant to C.R.S. S29-20-105, the City Council has held a public hearing on the proposed Foothills Gas Compressor Station Water Service Amendment after proper notice; and WHEREAS, the City Council finds that the proposed Foothills Gas Compressor Station Water Service Amendment is in the best interests of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The proposed Amendment to Intergovernmental Agreement for U.S. 36 Corridor Comprehensive Development Plan to Allow City of Louisville to Provide Water Service to Public Service Company of Colorado's Foothills Gas Compressor Station Approved in Boulder Land Use Docket #SI-06-001, ("Foothills Gas Compressor Station Water Service Amendment") a copy of which is attached hereto and incorporated herein by this reference, is hereby approved. Section 2. The Mayor is hereby authorized to execute the attached Foothills Gas Compressor Station Water Service Amendment, on behalf of the City Council of the City of Louisville, except that the Mayor is hereby further authorized to negotiate and approve such revisions to the Foothills Gas Compressor Station Water Service Amendment as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of such Amendment are not altered.
