<br />8. The preliminary plat and preliminary PUD development plan are proposed to be <br />served by a single access, that being Gateway Lane located off of McCaslin Blvd. This access <br />point is approximately 500 feet south of the intersection of McCaslin Blvd. and South Boulder <br />Road, both of which are four-lane arterial streets. <br />9. There was much testimony and evidence offered at the public hearing regarding <br />the impact the increased number of lots would have upon the function of the single point of <br />access. McStain testified that backgrourld traffic conditions would continue to impair the <br />function of the access irrespective of the density increase. Others testified that the proposed <br />increase in housing units would increase the number and severity of traffic conflicts at the <br />McCaslin Blvd.-Gateway Lane intersection, particularly for left turn movements out of the <br />Property onto McCaslin Blvd. The City Council finds that the proposed increase in housing units <br />will increase delay times for this left turn movement and will increase the likelihood of <br />congestion, traffic conflicts and traffic hazards at the McCaslin Blvd.-Gateway Lane intersection. <br />The City Council further finds that the proposed preliminary plat and preliminary PUD <br />development plan does not adequately address these traffic impacts related to the proposed <br />density as required by Chapter 17.28 of the LMC, including applicable provisions of Sections <br />16.16.010 and 17.28.120 which require that plats and PUDs be appropriately designed with <br />reference to circulation, access, safety, and traffic generated by the proposed development. <br />Section 2. Based on the foregoing factual findings, and based further on the evidence <br />and testimony presented at the public hearing, the City Council hereby concludes that the proposed <br />preliminary plat and preliminary PUD development Plan proposed for Gateway Lane does not <br />satisfy applicable criteria set forth in title 16 and 17 of the LMC, including without limitation <br />Sections 16.16.010, 17.28.110 and 17.28.120. <br />Section 3. Therefore, in accordance with the above findings and conclusions, the City <br />Council of the City of Louisville, acting on appeal filed pursuant to LMC Section 16.12.030, hereby <br />denies the proposed preliminary plat and proposed preliminary PUD development plan for <br />Gateway Lane Subdivision for the property legally described in Exhibit A attached hereto. <br />PASSED AND ADOPTED this 19th day of December, <br /> 3 <br />
