<br />Section 1. The City Council hereby approves the proposed Franchise Agreement by <br />and between Comcast of Colorado I, LLC and the City of Louisville, Colorado in the form of <br />such Franchise Agreement accompanying this ordinance, and hereby authorizes the grant of <br />franchise therein contained subject to and upon the terms and conditions of said Franchise <br />Agreement. <br />Section 2. The Mayor is authorized to execute the Franchise Agreement on behalf of <br />the City, such execution to be on or after the effective date of this ordinance and subject to the <br />requirement that Comcast shall have first executed the same. <br />Section 3. The term of the current franchise between Comcast and the City, as <br />granted by Ordinance No. 1197, Series 1995 and extended by Ordinance No. 1479, Series 2005, <br />is hereby further extended from the current expiration date of March 21, 2006 to the effective <br />date of the Franchise Agreement, or until such date that the current franchise is otherwise <br />terminated, but in no event shall the extension set forth herein extend past November 30,2006. <br />Section 4. If any portion of this ordinance is held to be invalid for any reason, such <br />decisions shall not affect the validity of the remaining portions of this ordinance. The City <br />Council hereby declares that it would have passed this ordinance and each part hereof <br />irrespective of the fact that anyone part be declared invalid. <br />Section 5. The repeal or modification of any provision of any ordinance or of the <br />Municipal Code of the City of Louisville by this ordinance shall not release, extinguish, alter, <br />modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, <br />which shall have been incurred under such provision, and each provision shall be treated and held as <br />still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings, <br />and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpose <br />of sustaining any judgment, decree, or order which can or may be rendered, entered, or made in <br />such actions, suits, proceedings, or prosecutions. <br />Section 6. All other ordinances or portions thereof inconsistent or conflicting with <br />this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or <br />conflict. <br />INTRODUCED, READ, PASSED ON ORDERED <br />PUBLISHED this 21 st day of February, 2006. <br /> 2 <br />
