<br />RESOLUTION NO. 13 <br />SJi:RIES 2004 <br /> <br />A RESOLUTION APPROVING A MINOR SUBDIVISION PLAT FOR ACME <br />PLACE, REPLAT 'A', A REPLAT OF LOTS 8, 9 AND 10, BLOCK 5, <br />ACME PLACE SUBDIVISION (533 AND 537 LINCOLN AVENUE) <br /> <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a minor subdivision plat for a two-lot single-family residential subdivision, to <br />be known as Acme Place, Replat A; and" <br /> <br />WHEREAS, all materials related to the minor subdivision plat have been reviewed <br />by City Staff and the Planning Commission and found, to be eligible for review as a minor <br />subdivision under the provisions of Section 16.12.120 of the Louisville Municipal Code <br />(LMC) as a "nonconforming lot of record"; and, <br /> <br />WHEREAS, City Staff and the Planning further find that the proposed subdivision <br />complies to the extent feasible, with applicable Sections of Chapters 16 and 17 of the <br />LMC; and <br /> <br />WHEREAS, after a duly noticed public hearing, where evidence and testimony <br />were entered into the record, including the findings in the Louisville Planning Commission <br />Staff Report of February 10, 2004, the Planning Commission recommended approval to the <br />City Council, with conditions; and, <br /> <br />WHEREAS, the applicant has provided written acknowledgment that they agree to <br />comply with the Planning Commission recommended conditions; and <br /> <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission and finds that the application should be <br />approved, with the following conditions: <br /> <br />1. Prior to recordation of the subdivision plat, the property owner shall install separate, <br />private sanitary sewer connections from the public sanitary main to each house, <br />subject to Public Works Department plan review, inspections and approval, as <br />required. <br />2. Prior to or concurrent with the recordation of the subdivision plat, a shared access <br />easement shall either be added to the plat or recorded by separate instrument. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Louisville, Colorado does hereby approve a minor subdivision plat for Acme Place, Replat <br />A, a replat of Lots 8, 9 and 10, Block 5, Acme Place Subdivision, subject to the above <br />conditions. <br /> <br />1 <br />
