The maximum height of all commercial buildings in the Old To'.vn CC <br />Zone District (as measured pursuant to the Louisville Municipal Code) is 29.0', <br />inclusive of any parapet or rooftop mechanical screen or any other architectural <br />element. (S) <br />Section 7. Section 4.2.D of the Louisville Commercial Design Standards and <br />Guidelines is hereby amended to read as follows (words to be added are underlined; words to be <br />deleted are stricken through)): <br />D. Except in the 01d Tovm CC Zone District, aArchitectural elements on <br />buildings subiect to the CDDSG. such as domes, dormers, spires, towers, etc. may <br />exceed the 42.0' height limit up to 50.0', when authorized through the PUD <br />process. In the 01d To'.vn CC Zone District, architectural elements such as domes, <br />dormers, spires, to\vers, etc. may exceed the 29.0' height limit when authorized <br />through the PUD process. (S) <br />Section 8. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective ofthe fact <br />that anyone part be declared invalid. <br />Section 9. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br />Section 10.
