<br />Sec. 3.07.020. Responsible party. <br />The administration of the provisions of this Chapter shall be the <br />responsibility of the City Manager or authorized designee. All department <br />directors and other staff members with spending authority shall be responsible for <br />compliance with these provisions in the expenditure of city funds. <br />Sec. 3.07.030. Purchasing policy and procedures. <br />The City Council may adopt by resolution procedures and regulations that <br />are not inconsistent with this Chapter for the orderly procurement of goods and <br />services and the management of procurement contracts. <br />Sec. 3.07.040. Competitive bidding requirements. <br />Before the city procures any goods or services, the city shall utilize the <br />competitive bid process and purchasing procedures as applicable and set forth in <br />the purchasing policy adopted by City Council. The purchasing policy shall set <br />forth bid requirements and approvals necessary for purchases and contract <br />execution. <br />Sec. 3.07.050. Successful bids. <br />Awards of bid provisions are solely for the fiscal responsibility and benefit <br />of the city, and confer no rights, duties or entitlements to any bidder. Bids shall <br />be awarded to the lowest, best and responsive, responsible bidder as determined <br />by the city. The city will solicit Louisville firms to submit bids whenever <br />possible. Such 10cal vendors must have a current business registration or sales tax <br />license on file with the city to be considered for bid award. Whenever such 10cal <br />sources exist and are competitive, purchases may be made from 10cal vendors; <br />however any award factors designated in the purchasing policy shall still apply. <br />Bids may be awarded as deemed appropriate solely within the discretion of the <br />city to local vendors provided their bid or proposal is within five percent (5%) of <br />the lowest bidder, or does not exceed five hundred dollars ($500) difference <br />between the bid of the local vendor and the bid of the 10west vendor, whichever is <br />less. This local vendor preference may not be applied in any situation where it <br />may be prohibited as a condition of any grant, or a violation of any other law. For <br />purposes of this Chapter, "bid" shall include bids, proposals and quotes, and <br />"bidder" shall include persons submitting bids, proposals or quotes to the city. <br />Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br />decisions shall not affect the validity of the remaining portions of this ordinance. The City <br />Council hereby declares that it would have passed this ordinance and each part hereof <br />irrespective of the fact that anyone part be declared invalid. <br /> 2 <br />
