Considering the nature oftelephone utility companies and the burdens placed <br /> by such telephone utility companies on the city, the classification of such utilities <br /> separately from other businesses and occupations IS reasonable and <br /> nondiscriminatory. <br /> D. The City Council of the City of Louisville is authorized to impose taxes on <br /> the privilege of engaging in occupations or businesses solely for the purpose of <br /> raIsmg revenue. <br /> Sec. 3.26.020. Definitions. <br /> As used in this Chapter: <br /> "Account" means a business transaction between provider and inhabitant whereby <br /> provider provides to inhabitant basic 10cal exchange service to a single address <br /> within the city. <br /> "Basic local exchange service" means "basic local exchange service" authorized by a <br /> certificate of public convenience and necessity, or otherwise, under Title 40, Article <br /> 15, Colorado Revised Statutes, as amended or recodified from time to time. <br /> "Base count" means the total number of accounts for which the incumbent provider <br /> provides basic local exchange service within the corporate limits of the city on <br /> January 1 ofthe current year. <br /> "Incumbent basic local exchange service provider" or "incumbent provider" means <br /> the company or entity providing basic local exchange service in the city as ofJanuary <br /> 1, 1979. <br /> "Inhabitant" means any individual, corporation, partnership, ioint venture, company, <br /> firm, association, proprietorship or other entity residing or having a place of business <br /> within the city. <br /> "New basic 10cal exchange service provider" or "new provider" means any company <br /> or entity other than the incumbent provider who enters the business of providing <br /> basic local exchange service. <br /> "New provider's initial count" means the number of accounts for which a new <br /> provider provides basic local exchange service within the city thirty days after that <br /> new provider's effective date, under this chapter. <br /> 2 <br />
