<br /> an addition often percent ofthe amount oftaxes due shall be and is declared to be a <br /> debt due and owing from such company provider to the city. The city attorney, upon <br /> direction of the city council, shall commence and prosecute to final judgment and <br /> determination in any court of competent jurisdiction an action at law to collect the <br /> such debt in the name ofthe people of the city. <br /> Sec. 3.26.070. Penalty. <br /> If any officer, agent or manager of a telephone utility company provider which is <br /> subj ect to the provisions of this chapter shall fail, neglect or refuse to make or file the <br /> annual statement of accounts provided in section 3.26.030 3.26.050, the officer, <br /> agent, manager or person shall, on conviction thereof, be subject to the provisions of <br /> section 1.28.010. <br /> Sec. 3.26.080. Inspection of records. <br /> The city, by its officers, agents or representatives, shall have the right at all <br /> reasonable hours and times to examine the books and records of the telephone utility <br /> company provider which are subject to the provisions of this chapter and to make <br /> copies of the entries or contents of such records. <br /> Sec. 3.26.090. Local purpose. <br /> The tax herein provided is upon occupations and businesses in the performance of <br /> local functions and is not a tax upon those functions relating to interstate commerce. <br /> It is expressly understood that none ofthe terms ofthis chapter shall be construed to <br /> mean that any telephone utility company provider is issued a franchise by the city. <br /> Section 2. Severance Clause. If any article, section, paragraph, sentence, clause or phrase <br /> of this Ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect <br /> the validity or constitutionality of the remaining portions of this Ordinance. The City_Council of <br /> Louisville, Colorado hereby declares that it would have passed this Ordinance and each part or parts <br /> thereof, irrespective ofthe fact that anyone part or parts may be declared invalid or unconstitutional. <br /> Section 3. Repeal. All other ordinances, or parts of any ordinances or other Code <br /> provisions in conflict herewith are hereby repealed. The repeal established herein shall not be <br /> construed to revive any ordinance Code provision or part thereof that had been previously repealed <br /> by any ordinance which is repealed by this Ordinance. <br /> 4 <br />
