NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Incorporation. The foregoing recitals are incorporated herein as findings of the City Council. Section 2. Subsection (b) of Section 2, Definitions, of Ordinance No. 1412, Series 2003, is hereby amended to read in full as follows (words added are underlined; words deleted are stricken though): (b) "Water and wastewater activity" includes but is not limited to the diversion, storage, carriage, delivery, distribution, collection, treatment, use, reuse, augmentation, exchange, or discharge of water or wastewater (including but not limited to sewage, aad liquid industrial waste, and storm, flood or surface drainage waters), or both, and including the provision of wholesale or retail water or wastewater or stormwater services and the acquisition of water or water rights. Section 3. The second sentence Section 2, Establishment of Enterprise, of Ordinance No. 1412, Series 2003, is hereby amended to read in full as follows (words added are underlined; words deleted are stricken though): "The Enterprise shall consist of the business represented by all of the City's water, v/astewater and sewer facilities and properties of the City's water and wastewater activities, now owned or hereafter acquired, whether situated within or without the City boundaries, including all present or future improvements, extensions, enlargements, betterment, replacements, or additions thereof or thereto, and including without limitation all facilities, properties and equipment utilized in the provision of water or wastewater or stormwater services. Section 4. Commencing fiscal year 2007, a stormwater activity account within the Water and Wastewater Activity Enterprise Fund shall be established to account for all revenues and expenditures ofthe stormwater activities of the City. Section 5. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. Such repealer is subject to the provisions of Sections 6 ofthis ordinance. Section 6. The repeal or modification of any provision of the Municipal Code or other previously adopted ordinance of the City of Louisville shall not be construed to adversely affect or impair any contract entered into by the Water and Wastewater Activity Enterprise prior to the effective date of this ordinance. Section 7. The repeal or modification of any provision of the Municipal Code or other previously adopted ordinance of the City of Louisville by this ordinance shall not release, 2
