<br />6. Standards Assumptions and LOS Standards in Impact Fee Study adopted as City <br /> Standards. <br /> The City hereby establishes as City standards the assumptions and Level of Service (LOS) <br /> standards referenced in the Impact Fee Stucjy as part of its current plans for future expansions <br /> to the City's Municipal Capital Facilities, Library Capital Facilities, Transportation Capital <br /> Facilities, Parks and Trails Capital Facilities, and Recreation Capital Facilities, and the Impact <br /> Fee system adopted in this Ordinance. <br />7. Impact Fees based on Impact Fee Study. <br /> The Impact Fees imposed on new development in this Ordinance are based on the Impact <br /> Fee Stucjy and assumptions and LOS standards referenced in the Impact Fee Stucjy. The Impact <br /> Fees are no greater than necessary to defray the projected impacts directly related to <br /> proposed new development. <br />8. Impact Fees Not Remedy Existing Deficiency. <br /> This Ordinance creates a system under which Impact Fees shall not be used to remedy any <br /> existing deficiency in Municipal Capital Facilities, Library Capital Facilities, Transportation <br /> Capital Facilities, Parks and Trails Capital Facilities, or Recreation Capital Facilities. <br />9. Impact Fees Finance and Defray Costs for Capital Facilities that Benefit New <br /> Development. <br /> This Ordinance creates a system under which Impact Fees paid by new development will be <br /> used to finance or defray all or a portion of the costs incurred by the City to construct City <br /> Municipal Capital Facilities, Library Capital Facilities, Transportation Capital Facilities, Parks <br /> and Trails Capital Facilities, and Recreation Capital Facilities to serve new development in <br /> ways that benefit the development that paid each Fee within a reasonable period of time <br /> after the Fee is paid. <br />Section 2. Chapter 3.18 of the Louisville Municipal Code, including Appendix A and <br />Appendix B thereto, is hereby repealed and reenacted to read as follows: <br /> Chapter 3.18 <br /> DEVELOPMENT IMPACT FEES <br /> See. 3.18.010 Short title, authority and applicability. <br /> Sec. 3.18.020 Intent. <br /> Sec. 3.18.030 Definitions <br /> See. 3.18.040 Development impact fee to be imposed. <br /> Sec. 3.18.050 Credits. <br /> See. 3.18.060 Impact fee trust fund. <br /> Sec. 3.18.070 Expenditure of impact fees. <br /> Sec. 3.18.080 Benefit districts. <br /> See. 3.18.090 Refunds of impact fees not spent or encumbered in six (6) years. <br /> See. 3.18.100 Review every five (5) years. <br /> Sec. 3.18.110 .Miscellaneous provisions. <br /> 2 <br />
