<br /> B. Upon the filing of a complaint, or upon the action of <br /> the City Pest Inspector, the property owner, agent, or tenant shall <br /> receive written notice by certified mail of such a complaint from the <br /> City Pest Inspector, notifying said owner, agent, or tenant that <br /> appropriate treatment must be undertaken within ten (10) days from <br /> the date of the notice to eliminate the infestation or breeding area. <br /> The notice shall further state that if the problem area is not treated <br /> within the specified time period, the City Pest Inspector shall take <br /> the necessary actions to treat the area. <br /> 8.40.040 Approved Treatment <br /> Infested areas or pest breeding areas shall be treated <br /> by one or more of the methods as shall be approved by the City Pest <br /> Inspector. Said methods shall include mowing, controlled burns, and/or <br /> the application of approved insecticides, herbicides, vegetation <br /> killers, or baiting. <br /> 8.40.050 Owner Liable For <br /> Costs of Controlling Pests <br /> In the event that an infestation or infection of pests is <br /> treated at the direction of the City Pest Inspector, the City shall <br /> assess the costs and expenses thereof, plus an additional administra- <br /> tive fee in the sum of $50.00 against the lots or tracts of land which <br /> were treated. <br /> 8.40.060 Lien to be Assessed when <br /> Owner fails to pay <br /> In the event an owner, agent or occupant, within thirty <br /> days after billing for pest treatment by the City as provided for <br /> in Section 8.40.050, fails to pay the costs and expenses of such <br /> pest treatment, a lien shall be assessed against the property for <br /> such pest treatment by the City Clerk. The City Clerk shall certify <br /> said assessment to the treasurer of Boulder County, who shall extend <br /> the assessment upon the tax roll and collect the assessment in the <br /> same manner as other taxes upon said property. <br /> Section 2. The City Council hereby finds and declares that <br /> this ordinance is necessary for the immediate preservation of the <br /> public peace, health and safety and that an emergency exists because <br /> of the following: <br /> -2- <br />
