<br /> I <br /> I <br /> , <br /> ORDINANCE NO. 735 <br /> AN ORDINANCE ADDING SECTIONS TO CHAPTER <br /> 2.36 OF THE LOUISVILLE MUNICIPAL CODE <br /> CONCERNING WRITE-IN CANDIDATES IN <br /> MUNICIPAL ELECTIONS AND THE CANCELLING <br /> OF MUNICIPAL ELECTIONS IF THERE ARE NO <br /> MORE CANDIDATES THAN OFFICES TO BE <br /> FILLED AT SUCH ELECTION, AND DECLARING <br /> AN EMERGENCY. <br /> WHEREAS, the Colorado State Legislature in Sections 31-10-306 <br /> and 31-10-503, as amended, has recently altered the law relative to <br /> municipal elections; and, <br /> WHEREAS, the City Council of the City of Louisville desires <br /> to provide that said changes in the law become part of the Election <br /> Code of the City of Louisville; <br /> NOVv, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> Section 1. The following sections are hereby added to <br /> Chapter 2.36 of Title 2 of the Louisville Municipal Code: <br /> 2.36.050 Write-in Candidates <br /> In any municipal elE~ction, no write-in votes for any <br /> municipal office shall be counted unless an affidavit of intent has <br /> been filed with the City Clerk by the person whose name is written in <br /> prior to five days be~ore the date of the election. Said <br /> affidavit of intent shall indicate that such person desires the <br /> office and is qualified to assume the duties of that office if elected. <br /> 2.36.060 Cancelling of Election <br /> In a municipal election 1 if the only matter before the voters <br /> is the election of persons to office and if, at the close of business <br /> on the Friday before said election, there are not more candidates than <br /> offices to be filled at such election, including candidates filing an <br /> affidavit of intent as set forth in Section 2.36.0501 the City Clerk <br /> shall certify such fact to the City Council. The City Council shall <br /> then hold a meeting and may cancel said election and by resolution <br /> declare the candidates elected, and upon such declaration by the City <br /> Council the candidates shall be deemed elected. Notice of such <br /> cancellation of the election shall be published, if possible, and <br /> notice of such cancellation shall be posted at each polling place and <br />
