<br /> c-' /~~~ZL <br /> ~ ~ <br /> G/ ~f7i/ <br /> ORDINll"NCE NO. 736 <br /> AN ORDINANCE AMENDING CHAPTER 2.08 OF <br /> THE LOIUSVILLE MUNICIPAL CODE CONCERNING <br /> VOTING RIGHTS OF THE MAYOR. <br /> , <br /> \WHEREAS, the Colorado State Legislature has revised the <br /> voting rights of the Mayor in ~.B.~. 31-4-102, as amended; and, <br /> - - - <br /> WHEREAS, the City Council of the City of Louisville desires <br /> to exercise the option allowed in said Statute to provide that the <br /> Mayor shall not be entitled to vote on all matters before the Council; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> THE CITY OF LOUISVILLE, COLORADO: <br /> Section 1. Section 2.08.020 of the Louisville Municipal <br /> Code is hereby repealed. <br /> Section 2. The following section is hereby added to <br /> Chapter 2.08 of Title 2 of the Louisville Municipal Code: <br /> 2.08.020 Voting Rights of the Mayor <br /> The Mayor shall be the presiding officer of the City Council <br /> but shall not be entitled to vote on any matter before the Council, <br /> except in the case of a tie vote. Any ordinance adopted by the City <br /> Council and all resolutions authorizing the expenditure of money or <br /> the entering into of a contract shall be subject to disapproval by <br /> the Mayor as provided in S.~.g' 31-16-104. This Ordinance is meant <br /> to specifically reinstate the previous voting powers of the Mayor as <br /> set forth by the previous Colorado State Statutes and shall take effect <br /> when the Mayor elected at the next municipal election takes office. <br /> Section 3. City Council hereby finds and declares that this <br /> Ordinance is necessary for the immediate preservation of the public <br /> peace, health and safety and that an emergency exists because of the <br /> following: <br /> S.~. g. 31-4-102 (3) , as amended, provides that unless the <br /> City Council adopts an ordinance such as this ordinance within the <br /> 60 day period preceding the election of the Mayor, said ordinance <br /> would not be effective. The next general municipal election for Mayor <br /> in the City of Louisville is scheduled for November 3, 1981, and <br /> therefore this ordinance must be in full force and effect prior to <br /> that date; also, the City Council finds that this ordinance is <br /> necessary to maintain the proper voting rights of the Mayor. <br />
