City of Louisville Planning Department <br />MEMORANDUM <br />To: Joe Stevens — Parks and Recreation Director <br />From: Troy Russ, AICP — Planning and Building Safety Director <br />Subject: Designation of the Helca Drive Right -of -Way and Utility Easement <br />Date: March 1, 2011 <br />PURPOSE <br />The purpose of this memorandum to outline the process and seek formal City Council <br />approval to complete the City's designation of right-of-way and dry utility ease for Helca <br />Drive on the City owned Outlot B of the Davidson Highline Subdivision and the <br />acceptance of the easement and right-of-way dedication for the Davidson Highline Trail <br />and Helca Drive from RMCS, LLC. from Lot 3A, also in the Davidson Highline Subdivision. <br />The Davidson Highline Trail and Hecla Drive, west of Hwy. 42, have been identified as a <br />key infrastructure improvements in the Louisville since 1989, when the City studied and <br />annexed properties north of South Boulder Road and east of the BNSF rail corridor. The <br />acceptance of the trail easement and the designation and acceptance of the Hecla right- <br />of-way are necessary procedural steps related to implementing Open Space Zoning as <br />required in Chapter 15 in the City's Home Rule Charter. <br />BACKGROUND <br />In 1990, Outlot B was dedicated to the City of Louisville in the Davidson Highline <br />Subdivision Plat as open space intended for use as a recreation trail and was to be <br />traversed by Helca Drive. The property is encumbered by a 50-ditch easement. While <br />the dedication states that the property is dedicated as open space, the City's 1989 North <br />Louisville PCZD General Development Plan, which guided the property's annexation <br />agreement (Wood Lockette) and the Davidson Highline Subdivision Plat, identified <br />proposed recreation corridor with a Helca Drive crossing. The trail corridor along with <br />Hecla Drive was identified in the City's 2005 Comprehensive Plan and Comprehensive <br />Plan's Update in 2009. <br />In 2010, the Takoda Final Planned Unit Development (PUD) provided the City an <br />opportunity to implement the City's long standing vision for the recreation trail and <br />Helca Drive. The final PUD and corresponding Subdivision Agreement committed the <br />developer to construct an enhanced meandering trail and Helca Drive.
