ATTACHEMENT #1 <br />Chronology - Davison Highline Trail and Hecla Drive <br />1983 Comprehensive Plan: The area was not part of the City. <br />1989 North Louisville General PCZD Development Plan: Identified the Outlot B as "open <br />space" WITH Helca Right of way traversing it. This plan grouped all publically owned <br />land into a single open space definition, including Helca, Hwy. 42; and South Boulder <br />Road. (Figure #1 - Attached) <br />1990 Wood Lockette Annexation Agreement: Requires development to be consistent with <br />the 1989 General PCZD Development Plan. <br />1990 Davidson Highline Sub -Division Plat: This Plat was required to be consistent with the <br />above 1989 GDP for Public Land Use Dedication —'By these presents, 1 do hereby <br />dedicate to the City of Louisville and to the public forever, Outlot A and B for open space, <br />as laid out and designated on this plat." (Figure #2 - Attached) <br />2000 Ord. No. 1329-2000, § 1, 2-15-00 - MANAGEMENT OF OPEN SPACE LANDS <br />a. Section 4.01.020 of the Louisville Municipal Code <br />• Open space shall mean and include land designated as open space on <br />the city zoning map attached hereto as Attachment A* as may be <br />amended from time to time by the city council, or as may be designated <br />in the future by the city council upon recommendation of the board. <br />Generally, such lands are undeveloped lands that are owned solely or <br />jointly by the city with the intent that the land would be designated as <br />open space buffers, agricultural land, wildlife corridors, wildlife habitat <br />or other undesignated undeveloped land. Open space shall not include <br />parks, developed recreation areas, or the 96th Street connection. <br />o The 2006 Zoning Map identifies Outlot B as City Park and Open <br />Space. (Figure #3 —Attached) <br />b. Section 4.03.050 (E) of the Louisville Municipal Code <br />■ Notwithstanding the foregoing, all current uses and all uses <br />contemplated in any intergovernmental agreement or other contractual <br />obligation of the city in existence before the enactment of this chapter <br />will be allowed unless and until the city council recommends a change <br />and takes all necessary legal steps to implement such a change. The <br />board may recommend such a change to council at anytime. <br />2000 ESCO Open Space Master Plan Map: Outlot B is identified as a trail, not open space. <br />• Outlot B is not provided an open space management zone designation <br />(Figure #4 - Attached) <br />2005 & 2009 City Comprehensive Plan: Identified the parcel as "open space" WITH Helca Right <br />of way traversing it. (Figure #5 - Attached) <br />2010 Takoda PUD <br />a. Shows Helca consistent with the comprehensive Plan aligning Helca ROW to the <br />property line of Outlot B. (Figure 6 - Attached) <br />b. Commits to a betterment of the trail by piping the Davidson Highline Ditch and <br />realigning the trail in a meandering nature in Lot 3A of the Davidson Highline Lot <br />3A crossing Helca at -grade. (Figure #7 - Attached) <br />
