Planning Commission <br />Bolder Tutor SRU <br />April 14, 2011 <br />BACKGROUND: <br />The applicant, Michelle Thomas of Bolder Tutor, LLC, requests approval of a special review <br />use (SRU) to operate a private school at 1371 Hecla Drive. The property where the school is <br />proposed is controlled by the Alvenus Park Planned Unit Development (PUD). The Alvenus <br />Park PUD was approved in July of 1994 and allows the following uses in the building located <br />at 1371 Hecla Drive: <br /> Medical and dental clinics <br /> Any retail trade or service business <br /> Professional, business and administrative offices <br /> Financial offices, including banks and savings and loans <br /> Accessory structures and uses necessary and customarily incidental to the uses <br />listed in this section <br /> Research, office and corporate uses, and facilities for the manufacturing, <br />fabrication, processing, or assembly of scientific or technical products or other <br />products, if such uses are compatible with surrounding areas. <br />The Alvenus Park PUD does not explicitly permit schools in the development. Section <br />17.28.230 B.2 (Control of development after completion) of the Louisville Municipal Code <br />(LMC) requires that “any uses not authorized by the approved final plan, but permitted in the <br />planned unit development as a use by right under the provisions of this title or by special <br />review in the zone in which the planned development is located, may be added to the final <br />development plan under the procedures stated in chapter 17.40” (Special Review Use). The <br />applicant is going through the Special Review Use process to permit a school as part of the <br />Alvenus Park PUD. <br />OVERVIEW OF PROPOSAL <br />The proposed school would be located in an existing medical and office building at the <br />intersection of Hecla Drive and Plaza Drive. The school would be one of ten tenants in the <br />building which currently contains some medical and dentist offices along with a few financial <br />management businesses. The proposed space for the school is located on the southern end <br />of the building and has its own entrance area separate from the other office spaces in the <br />building. The area to the north of the subject property is zoned Planned Community <br />Residential/Commercial and is currently being developed with single and multifamily housing <br />(North End Subdivision). The remainder of the area surrounding the proposed school is <br />occupied on the west and south by the Balfour Retirement Community, and a legal office to <br />the northeast across Hecla Drive. <br />2 <br />
