PAGE TWO <br />SUBJECT: UPDATE/DISCUSSION – BOARD OF ADJUSTMENT (BOA) <br />DATE: MAY 10, 2011 <br />SUMMARY NARRATIVE: <br />A description of each case, including the date heard and final outcome follows: <br />May 19, 2010 <br />1024 Grant Avenue - Case #10-008-VA: Approval of a variance from Section 17.16.030.C of <br />the Louisville Municipal Code (LMC) to allow for a one level (plus basement) addition to the <br />existing single family home which would be located 3 feet 4.5 inches from an accessory <br />structure on the property. <br />Staff Recommendation: Approval <br />BOA Decision: Approved <br />June 16, 2010 <br />105 Roosevelt Avenue - Case #10-011-VA: Approval of three variances from Chapter 17 of the <br />Louisville Municipal Code (LMC). The variances are described as follows: <br />1. Variance from Section 17.12.040 to allow for two lots, one with a width of 60 feet and the <br />other with a width of 40 feet, where a minimum lot width of 70 feet is required. <br />2. Variance from Section 17.12.040 to allow for a 6,000 square foot lot where the minimum lot <br />area is 7,000 square feet. <br />3. Variance from Section 17.12.040 to allow for a dwelling unit on a 6,000 square foot lot <br />where the minimum lot area per dwelling unit is 7,000 square feet. <br />Staff Recommendation: Denial <br />BOA Decision: Approved <br />November 17, 2010 <br />1324 Grant Avenue - Case #10-027-VA: Approval of a variance from Section 17.16.030.C of <br />theLouisville Municipal Code (LMC) to maintain the current 4:12 roof pitch for a 65 square foot <br />addition to an existing home, where a 6:12 roof pitch is required. <br />Staff Recommendation: Approval <br />BOA Decision: Approved <br />2011 WORK GOALS <br />The Board of Adjustment will continue to hear Variance and Floodplain Development requests <br />th <br />as they are submitted. The first case before the BOA in 2011 was heard on April 20. <br />Section 17.48.100.B (1-6) of the LMC identifies six criteria for approval that must be met for a <br />variance to be approved. Specifically the section reads: <br />“…The board may grant a variance only if it makes findings that all of the <br />following requirements, insofar as applicable, have been satisfied: <br />1.
